I am aware of no laws that prevent your bank from closing your account for any reason (although I am certainly no expert in Illinois law), other than race, gender, nationality, and similar discriminatory motoves.  Therefore, your respective rights in this area depend on your contract.  What does the agreement pursuant to which you opened your account say?  I don't know, but I would be that it is a form created by the bank, and therefore is very bank-friendly, and probably allows the bank to close the account for any reason.... You erred when you purchased the property -- you failed to conduct a survey and thus have taken the property subject to the encroachment. The title company's policy expressly omits coverage for matters that could have been detected through a survey.
