Answered 8 years and 2 months ago by NA smsattorney@gmail.com (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
You will need the help of a competent attorney that is both flexible in fees and great at what he does in representing defending grandparents rights. You can start now if you want. Please keep in mind that not all lawyers are same. Therefore be very cautious as to which attorney or law firm you chose to work with. We are based in New York City but my network of SMS ATTORNEYS does travel out of state for complex cases and at client request. If you would like to retain our services while on a limited budget, do let us know and we will try to do our best to offer payment plan option. Feel free to give us a call for a free consultation. Ahsan Syed answer and comments to questions are for general purposes only and do not constitute legal advice or establish an attorney-client relationship with SMS ATTORNEYS without a signed retainer. Can a parent take the child out of state without the permission of the other parent?

Answered 12 years and 2 months ago by Mr. James Paul Peterson (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Family
Unless the order is set up in such a way as to prevent one parent from moving far away with the child, then that parent may move far away with the child. However, it is required that each parent give the other parent their address and phone number.

Do I still have custody?

Answered 12 years and 3 months ago by Frances An (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Family
You need to go to court for custody, and prove what you say is true. If the children are over 5, they can talk to a mediator and tell the mediator what they want. Do you have a job? That might be your first step so that you can show that you are a responsible adult, capable of caring for children.... Read More

What is the proper way to file ex parte motion regarding custody?

Answered 12 years and 3 months ago by Diane L. Berger (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
I do not believe this is a matter that is pending in Nebraska, but the following would be what would be needed in Nebraska. You need to file an Application to modify setting forth the basis for your request for custody. You need an Affidavit signed by you in the presence of a Notary Public setting forth why you believe your child/children would be in danger if they remained in their mother's custody pending the hearing on the Application to Modify. Finally, you will need a proposed Order for the Judge to sign setting forth the relief you are requesting and also having a provision for a full hearing so that the Judge can fill in the date and time of that hearing.... Step-father adoption when bio dad was very abusive

Answered 12 years and 4 months ago by attorney William R. Pelger   |   1 Answer   |  Legal Topics: Family
You need to ask a loal NE attorney this question. At least in my state, parental rights are strong. In order to get the father out of the child's life you need to have him voluntarily give up his parental rights or file a petition to him him involuntarily give up his rights. The latter would require him to fail to meet certain criteria under state law. This is why you need to contact a NE lawyer.... Read More

Can I compel my childโ€™s father for a child support to our child?

You must begin a paternity action to have it proved he is the father. And once he is father, he has the responsibility to support the child. How can I get my mother-in-law out of my house?

Answered 12 years and 7 months ago by attorney William R. Pelger   |   1 Answer   |  Legal Topics: Family
Thats a tough one, your H has to be on board with what you want or its not gonna work. This is a family matter and really not a legal one. I mean, you could just change the locks and throw her out ,or even evict her even though she is not paying rent pursuant to some month to month agreement. I would suggest talking it out, getting your feelings on the table. you could see if counselling is available through an employer or otherwise. there is family counseling and you are not the first person with this situation....
