What you are asking for to get an answer to is how to alienate a parent right to his/her child. I understand that you may be said because he left you for another woman at this time. I am surprised that your employment is at will, as I would have expected it to be subject to the hiring and firing provisions of a collective bargaining agreement.  As an at will employee, your employment can be terminated for any reason not prohibited by statute.  If you believe that termination of your employment resulted from discrimination based on a statutorily prohibited reason (e.g. race, religion, age, etc.) you may have a claim.  Even if not, however, unless you are being offered something for resigning, I don't see why you would, unless you think it will look better to a subsequent employer than being fired.... Look at INA 212(a)(9)(C) - (C) Aliens unlawfully present after previous immigration violations.- (i) In general.-Any alien who- (I) has been unlawfully present in the United States for an aggregate period of more than 1 year, or (II) has been ordered removed under section 235(b)(1), section 240, or any other provision of law, and who enters or attempts to reenter the United States without being admitted is inadmissible. (ii) Exception.-Clause (i) shall not apply to an alien seeking admission more than 10 years after the date of the alien's last departure from the United States if, prior to the alien's reembarkation at a place outside the United States or attempt to be readmitted from a foreign contiguous territory, 14a 6aa the Secretary of Homeland Security has consented to the alien's reapplying for admission.
