Yes. Your insurance company will want to get their money back if you win. So, you'll need to sue for all the damages. Tell your insurance company what you are doing. However, your insurance company may sue her anyway and that may save you the time and effort. If they do, you can piggy back their case and join in to get all of your damages. Talk to your insurance company about what they plan to do. Good luck.... Read More

Am I still liable through my insurance to cover another person's vehicle that doesn't have a drivers license?

Answered 12 years and 2 months ago by Georges Herman Shers (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Personal Injury
You are liable if you were at fault in the accident. If the lack of a functioning horn had anything to do with the cause of the accident if sounded you would have been able to avoid impact or apply brake so physical damage less, etc., then the percentage of your fault would be reduced. If the lack of a license, insurance, a working horn, etc., had nothing to do with the cause of the accident then there is no negligence by the other driver as to the accident.... Read More

What did his lack of a license or his lack of a horn have to do with the accident? If the accident is clearly your fault, then you are liable.

Yes, it is a often asked question. I am uncertain whether your are speaking of the eyeball or eyelid. ?In any case, she needs to see some attorneys who practice medical malpractice suits to explain what happened in greater detail, her symptoms, medical bills, what the Dr. said before the operation about the possibility of ?adverse effects, etc. He/she can then discuss if the case has value enough to justify the cost and risk of a lawsuit.... You need her to consult with an expert medical malpractice attorney. A bad result does not mean that malpractice occurred. There are known risks, and it would be necessary to prove this was not an anticipated consequence.

Not if you mailed in the money in time for it to be received before the court date. If mailed or received after, you could have a problem.

Can my attorney charge me office cost and fees beyond his 1/3 of settlement?

Answered 12 years and 3 months ago by Georges Herman Shers (Unclaimed Profile)   |   12 Answers   |  Legal Topics: Personal Injury
You have to read your contract with him. Normally office expenses are not counted but out of pocket costs are sometimes. The contract should directly state how the 1/3rd fee is calculated. You also need to look at whether the fees are deducted from the gross settlement amount or the net amount [latter better for you but probably will not make much of a difference]. If the contract is silent, then what occurs in local practice probably would apply, but since the costs are under $100 you may be able to get the attorney to back down by telling him you though the fees were on the net sum. But in any case, you probably are responsible for the two records costs he incurred.... Read More

Can my attorney charge me office cost and fees beyond his 1/3 of settlement?

The fee contract that you signed with the lawyer should incorporate all of the terms of the contract. Both you and the lawyer are bound by the terms of the contract. In Wisconsin, all contingent fee contracts must be in writing and signed by the parties.
