If his psychologist says he is disabled and unable to function, then he would have a valid chance of obtaining SSI. I assume he is in Special Ed. This testing that was done at the school may also be probative. I would be interested to know why his claim was denied at the lower level. For more information contact me at www.virginiadisabilitylawyer.com.... Read More

You need to show you have worked a certain amount of time (quarters) in order to qualify for disability. If Social Security says you lack quarters, it means your work history was not long enough to qualify for benefits.

She should re-apply for disability. With the new medical information from her strokes, she may well prevail without an attorney. If she is denied she can contact my office through my web site at www.virginiadisabilitylawyer.com.

back problems

Answered 11 years and 11 months ago by Gerald Gregory Lutkenhaus (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security Disability
It depends. If your doctor supports your claim for disabilty this would be a first step. It also depends on your age, work skills, and education. If you under age 49 then it is difficult unless your doctor is willing to rule out all jobs that exist in the national economy and this includes all desk work. ... Read More

disability

Answered 12 years ago by Gerald Gregory Lutkenhaus (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security Disability
It usually takes 120-150 days for the initial application. You claim you have not heard anything in 10 months. That is too long. You need to check with your local Social Security Office to check on the current status of your claim. Also call 1-800-772-1213 to check on the status of your claim. ... Read More

is it too late to get a lawyer when I got denied for disability in December?

you have 60 days to appeal a denial.  if you did that, then you can get a lawyer to take over from here on out.  if you did not appeal in the 60 day window, however, then you are best off re-applying and then seeking a lawyers help if you get denied again (and seeking that help well before the 60 days run out).... No you are not required to have an attorney or representation. In SSA, you pay nothing unless the claim is won.  See if you qualify by CLICKING HERE.   Open the online review application form.   Answer the questions in full and the best you can.   Once completed, click to send the form back to me.   Your answers are kept in full confidence.  Once received by me, I will then review your answers and contact you regarding whether or not you may qualify for applying for social security disability benefits and how your application can be filed for you on line.      ... No you do not need a lawyer or representative to file an initial application for Social Security disability. However it may be to your benefit to help you to do so. This is because if you have limited or no access to the Internet a representative or lawyer can gather all the information on file for you online.  Filing online can be frustrating to the uninitiated, so you may want somebody to help or assist you to do so.... My knee was rated as having lost 25 percent use. Is it anyway i can apply for particle disability?

Answered 14 years and 2 months ago by Michael J. Haller, Jr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security Disability
Unfortunately SSA does not have a "partial" disability program, but your State may. I'm sorry to hear your knee is not doing well. To receive disability, by law, Social Security has a very strict definition of disability. To be found disabled: • You must be unable to do any substantial work because of your medical condition(s); and • Your medical condition(s) must have lasted, or be expected to last, at least 1 year, or be expected to result in your death. http://www.socialsecurity.gov/disability/disability_starter_kits_adult_factsheet.htm#disability You may want to review http://www.socialsecurity.gov/hlp/radr/10/ent001-disb-info.htm regarding Social Security's Disability Programs, and http://www.socialsecurity.gov/disability/ and of course, SSA's website. ...
