It'll help but probably not as much as you think. Retirement benefits are based on your highest 35 years, not the past 3 or 5 years like some pension plans.  In addition, earnings are adjusted for inflation so it may not help at all unless they replace lower adjusted years.  My guess is that it will result in a slightly higher amount but I wouldn't keep working just for that reason. Work because you want to work or need the money, don't do it for a few extra SS retirement dollars. ... Read More

This really isnt a question for the Social Security section of this website. You can't get a new SSN for your situation. I am not an expert in this area, but I would suggest getting a fraud monitoring service that alerts you if there is activity on your credit report.

How do I get help for a 70+ y.o. friend who's social security has been cut off?

Answered 8 years and 3 months ago by Richard Samuel Price (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security
It sounds like she turned an exempt asset, her house, into a countable asset, money in the bank.  This will make her ineligible for SSI or Medi-Cal.  She may be able to create a Medi-Cal asset protection trust or some other type of planning that makes her eligibel for benefits.  Call or email an attorney for a full consultation.... Medi-Cal is a needs-based program that requires you qualify for benefits.  There are multiple ways for you to qualify, depending on your situation.  Contact an attorney to help you with applying for Medi-Cal.... don't say something to Social Security that is not true.  You are not married so that is what you should say in the paperwork.  But if anybody supports you your SSI can be reduced.  Go back into the SSA office and give them some proof that your BF moved out and does not support you.  ... Read More

It appears you have provided a paragraph from a divorce Decree, Settlement or Order.  I note you are from California, a community property law state - click here for an excellent article regarding community property.  It is not clear, but it appears you are referring to Social Security Disability benefits. Because I do not practice family law and I am not licensed in a community property state, I cannot render an opinion.  Rather, I offer these suggestions: 1.       Contact your divorce attorney that handled the case, and get an opinion; or seek an opinion from another attorney. 2.       Post your question online in the Divorce area. 3.       Contact SSA.  They may be able to give you some insight, but remember, they aren't lawyers, and you don't want to violate a Court Order. Community property is a very unique type of law, and you want to get a clear opinion from a professional on this one.  Thanks for a great question, and good luck.... Read More
