Theft is committed at the time you take the money.  Whether you pay it back or not, that doesnt change the fact that it is a theft.  Pay it back and hope he doesn't report you to the police. If he does and you are charged with a crime, hire a lawyer.  Good luck.

Multiple parties can be held criminally responsible for a crime (the law of parties). If you assist in the planning, commission, or flight/covering up of a crime, you are equally responsible. The  district attorney can believe all, some, or none of a confession - as could a jury if he is charged. If you are going through the Attorney General, they will have the court order a DNA test on the presumed father. If he is indeed the father, it doesn't matter whether he signed the birth certificate, he will be required to pay child support and the court will most likely order the birth certificate amended to reflect the kid's paternity.As far as your personal life goes and him bringing up bad things about you, gather as much evidence as you have to the contrary. Unless you are engaging in criminal conduct, it is typically difficult for a father to gain full custody of an infant in Texas.... If the charges are still pending you can hire a lawyer to represent you on the charges. Even if the charges are eventually dismissed, you are unlikely to succeed on a lawsuit against someone because you believe you are falsely accused. Charges are dismissed in courts every day; but, defendants don't automatically get a right to sue the police or anyone else because they were accused of the crime. That being said, I am certain you can find an attorney to file a lawsuit for you if you pay a retainer fee up front and ongoing hourly legal fees.
