Need to know if my ex wife can get a settlement from are son who past away seven years ago he didn't have a will

Answered 4 years and 11 months ago by Andrew Allen Popp (Unclaimed Profile)   |   1 Answer
It sounds like the settlement should be paid out to the estate of your son.  Without a Will, your rights to receive a portion of the estate would be governed by Ohio's Rules of Descent and Distribution. (O.R.C. 2105.06).  You may want to retain an attorney in your area to investigate this matter and represent your interests. Best of luck.... Read More

It sounds like there may be some criminal issues against this guy.  False report to law enforcement, stalking etc.  You may also have grounds for a restraining order.  Have you sat down and spoken with a detective?  You may want to get law enforcement involved from your perspective.    Best of luck.... The specific topic this involves is known as "adverse possession."  As for whether or nor the other party can establish adverse possession depends on several factors.  Generally speaking, adverse possession requires a "hostile / adverse claim, actual possession, and exclusive, open and notorious possession of the property. You should speak with an attorney in West Virginia who practices in that area of law for a more detailed analysis. Best of luck.... Read More

credit card

Answered 5 years ago by Andrew Allen Popp (Unclaimed Profile)   |   1 Answer
If you cosigned for the credit card, you are likely still liable for the debt accumulated.  It really depends on the documents you signed.  That being said, credit card companies regularly settle claim for outstanding balances.  You can try to deal with the credit card company yourself, but may find more success if you hire an attorney.   Best of luck. ... Our neighbor's huge podocarpus tree roots are damaging our property. The neighbor won't cut down the tree.

Answered 5 years and 2 months ago by David Alan Schechet (Unclaimed Profile)   |   1 Answer
The HOA is right.  If you can't reach an agreement with the neighbor, a lawsuit would have to be filed.  Is there any nuisance?  Is your plumbing compromised?  Is a barrier, i.e. a fence, being destroyed?  Acting on your own, even on your side of the property could expose you to liability.  Be careful.... Ethical behavior.

Answered 7 years and 2 months ago by attorney Renea Overstreet   |   1 Answer
Your time and money would be better spent on finding an attorney who will complete your divorce. You could contact the local bar association to get names of good attorneys. Go to two or three consultations and find an attorney you feel comfortable working with.

Boat dealer claims sales tax was underpaid

Answered 7 years and 7 months ago by Jonas Urba (Unclaimed Profile)   |   1 Answer
Have you requested a copy of the notice from the state taxing authority? I am guessing you may have purchased the engine in a state other than the one you live in or more importantly the state where that boat is registered and licensed. Taxes are the responsibility of the person who purchases the product. If I bought a car in Connecticut and registered it in new York and the Connecticut dealer calculated a tax underpayment that's my problem. Speak to a tax attorney since I know very little about tax but my educated guess says you will probably owe the registration state whatever they calculate taxes on the fair market value of that engine no matter how great the price you negotiated was unless it's within a reasonable range of what a similar engine sells for.   A common trick would be to pay a fraction of the cost with a cashier's check and the balance in cash and ask the dealer to write a sales price just on the cashier's check amount. New York state civil servants are way too smart to fall for that.... Read More

can I sue medicare and MVP insurance for refusal cover my doctors knee brace order

Answered 7 years and 7 months ago by Jonas Urba (Unclaimed Profile)   |   1 Answer
You are asking a civil litigation, health insurance, possible breach of contract question. This is best answered by attorneys who limit their practices to those areas or possibly "consumer protection" lawyers. You may need to investigate possible class actions being conducted by attorneys general or private counsel. Your insurance contract might include alternative dispute resolution? If not, prepare for litigation  by consulting with the types of lawyers I mentioned.... Read More

I own a Trucksr Hat company and our sales have plummeted since we found out Wal-Mart is selling our product.

Answered 7 years and 9 months ago by Jonas Urba (Unclaimed Profile)   |   1 Answer
You have a potential breach of contract issue. If you have no reseller restrictions in your sales agreements with your customers why would my (assuming I bought from you) reselling the product you sold me, at whatever price I want, be illegal? If I bought 50 Big Macs from one McDonald's every day and sold them to my employees for $1 cheaper could another McDonalds down the street sue me because I was cutting into their profits for selling Big Macs for less? Will you not have to raise prices across the board if you dont contract your problem away?... Read More
