Potentially yes. Your agent has a fiduciary obligation to make policy changes as requested by you.  If the agent failed to do so, then he can be sued for what is -- in effect -- a type of malpractice. However, your policy may contain language requiring changes to be in writing.  Also, if you received policy renewal paperwork between the phone call and the accident, then you had the obligation to review that paperwork to ensure that the coverage you were paying for was the coverage you intended. Your complaint appears to be with your agent for errors and omissions and perhaps not the insurance company.... Read More

Car Accidents Can't Be Blamed on Driving Without a Valid License or yes?

Answered 11 years and a month ago by attorney Stephen S. Mazzei   |   1 Answer   |  Legal Topics: Car Accident
Being a licensed driver has nothing to do with who is at fault for an accident.  While your mother can be cited for ndriving without a license, negligence aka fault for the accident is a separate issue.

Possibly the dealer could do something. But were you hurt? Who is your lawyer handling the case. Ask him/her to check out the failed airbag issue.

What are your medical expenses? Multiply your medical expenses by 1.7 and that will give you a good idea of the value of your case. Because you are signed up with a lawyer, you are basically screwed since if I or any lawyer were to take the case, lawyer #1 would claim the fee.

What can I do to get driver at fault to pay for damages to my car?

Answered 13 years and 11 months ago by John Paul Bisnar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
John Bisnar It is to expensive to hire a car accident attorney to represent you in a matter like this, in my opinion.  If you can get an attorney to write a demand letter for you at a reasonable price, that may be a great way to go. First thing I would do is contact my insurance company and see if they are going to pursue the truck driver for the money they paid to fix the car.  Your insurance company is entitled to get back what they paid from the truck driver.  If you can, work with them to collect both your $500 deductable and your $600 rental car bill. If you do nothing and your auto insurance company collects what they have paid out from the truck driver, they should be collecting and reimbursing to you your $500 deductable. If you can't get it worked out with your insurance company to collect the money for you, sue in small claims court. I was involved in a MVA accident in October of 2009. We are going to trail and I have not heard from my attorney''s in months? Grounds to fire?

Aimmee,  I am not surprised that it has taken this long to get to trial.  That is fairly common; however, your attorney should return your phone calls.  If you can't get a return call, then you should schedule an appointment so that your attorney can explain to your satisfaction, what is going on with your case.  Good luck!  Chip Clark...
