At 15 it would be very difficult to get custody of your youngest sibling. You are not at the age of consent yet. It is further complicated by the fact she is in another country. I would suggest that you talk to a lawyer so that they have all the information that may be able to help you.

Are you represented by an experienced family law attorney? If so, consult your attorney. Otherwise I suggest you consult with an experienced family law attorney to assist you. In Arizona you would file a petition to enforce the parenting time orders.

If there is no objection from her bio-dad, under the circumstances described this should be by agreement. See an attorney and do it right.

What you should do, with your husband, is consult with an experienced termination/adoption attorney in your area to discuss the probabilities of the court ordering that the biological father's parental rights be terminated. Unless the biological father would consent to the adoption by your husband, then this would be the first step. In Arizona, in order for an adoption order to be entered, there must be a home study. This is also the case with a termination. Again an experienced termination/adoption attorney can explain all this to you.... Read More

If she is planning on leaving that soon, you need to consult with an attorney and file a legal action immediately to prevent her from doing so. It is much easier to keep her here than it is to bring her back.

What are my rights as a grandmother to keep my grandchildren?

Answered 12 years and 5 months ago by attorney Jeffrey Wittenbrink   |   6 Answers   |  Legal Topics: Child Custody
A grandparent who has physical custody of children and who has had them for a period of time has a right to sue for their continued care, custody and control. "Legal guardianship" is not a term normally used in Louisiana, so the status of the grandparent in this case is not really clear from this letter. If a grandparent has custody pursuant to a court order, the mother would have to file suit to regain legal custody. A person in this situation should contact a competent family law attorney immediately to ascertain their rights and actions to take.... Read More

It sounds like you should go to family court and file a petition for custody and a habeas to return the child. These are complicated issues so you should consider getting a lawyer to help you. Good luck!
