When a judge strikes a motion, he removes the motion from the court docket. After a motion is stricken, it must be re-noted for hearing. If the notice from the lawyer is a re-note or a note for hearing, then that is the new hearing date. If you are confused at all, I recommoment that you call the court clerk's office and ask whether the motion is on for hearing as stated in the lawyer's communcation to you. Hi, Pete. The short answer is that current income is always a factor in child support--first wife, second wife--doesn't matter, the kids are all your kids. Support should be divided evenly between them. When child support is caclulated for your planned divorce, you will get a credit for other children that you are paying support for. You should be getting a whole family credit on your calculations for your child support for each child. Talk with a local family law attorney in your area. Most family law offices, like ours, has specialized software to allow us to "run the numbers" fairly quickly to let you know what the impact of any changes might be.

Greetings, TJ. Whether your ex is working may or may not change your child support. You can run the numbers using the Washington State forms. It sounds like your spousal maintenance obligations are in a bit of a gray area. You should likely ask the court for assistance on that.
The method to ask the court to clarify or change a prior order is by motion, but the rules are different for child support and spousal maintenance. You must use the mandatory forms. The forms for Washington family court can be found at http://www.courts.wa.gov/forms/?fa=forms.static&staticID=14. Use the general "motion" form for spousal maintenance. File it in the same court and under the same case number where you obtained your divorce decree. Point out that it was never the intent to pay spousal maintenance indefinitely, and ex is not going to school, so it should stop.
If you run the numbers and child support is too high, you must file and serve a petition to modify child support. Look for the section in the forms website that deals with child support modification. You will find the necessary forms there.
Finally, all of this is a bit complicated. You should seek the help of a qualified attorney. If you have no money, check for a "legal aid" office nearby. You may qualify for free or reduced cost help by an attorney. Also, your local county "family court facilitator" can help you select the correct forms, fill them out, and get them filed correctly. You can find the family court facilitator by calling the superior court and asking for the family court facilitator. The charge is nominal. Good luck!!!

Your ex can be held in contempt for failure to pay child support, can be jailed, and his license to drive can be suspended.
