How do you find a honest and qualified attorney for legal malpractice?

It is very difficult. Most attorneys will not take a suit against another attorney, especially on contingent basis. Hi, Technically, no this is not allowed and is a massive invasion of privacy. However, if it is court ordered, then likely a judge signed off on it and judges typically have absolute immunity. So if it truly was court ordered and signed by a judge, then there is little you can do. If he is lying and just signed the documents, you'd have a major law suit against them. What redress do I have against the justice system for being unjustly incarserated?

Wow. I'm sorry to hear you went through this. You have a few options (none of them all that great). You can determine if it is worth of bringing a false arrest/malicious prosecution claim against the municipality that incarcerated you. However, remember that simply being arrested, and acquitted does not per se make the arrest false, or the prosecution malicious.  If the attorney really screwed up and but for their screw up, you would have won your case (very difficult to prove with jury trials) then you can bring a suit against the attorney for malpractice. However, this is tricky. Very few attorneys are willing to take a suit (especially contingent) against another attorney. And taking on an attorney pro se is an uphill battle that will likely leave you down and out.  It is possible you can bring suits against the people who got you arrested in the first place (if any) although it sounds like the statute of limitations have ran out (3 years in Federal) on most of these claims.  Like I said, I didn't have promising news for you. Hi, thanks for writing. Unfortunately, witnesses have absolute immunity from suit while testifying for an ADA. Therefore, malicious prosecution would have to be brought against the municipality. However, that too is very tricky. DAs too have absolute immunity unless they are investigation or acting with malice above and beyond their duties as an ada. This is very difficult to prove. Audio recordings of conversations are usually inadmissible hearsay in court, so they are of little consequence to your case.  It would seem to me, based on the limited knowledge of your case, that your best bet would be to sue the individuals for false arrest. There is no tort of perjury. It is a crime however, to lie under oath, so its possible that you can schedule a visit with an ADA and see if they are willing to take on the case and issue a warrant.  That being said, be cautious of suing people with limited assets. It will consume your life, and ultimately won't get you the justice you thought it would. If they were smart, they wouldn't even show up. And you'll now have a default judgment against someone with no assets. Brother from Europe was caught shoplifting in NYC. Can I go to court instead of him?

Unfortunately, no. It all really depends on what he's facing (i.e. charged with) as well. It is likely a Misdemeanor in which case he would have to appear. If he doesn't appear a bench warrant will be issued for his arrest and the next time he lands in the US he will likely be immediately arrested. The only way around this is if he were to hire an attorney and sign a waiver allowing that attorney to appear on his behalf. If you are not an attorney, you can not appear on his behalf (unless for emergency purposes like he was recently admitted to the hospital, etc.).    If you'd like, my firm would be more than happy to handle the appearance for him.
