Will I loose my car if I am not approved for a loan?

Answered 8 years and 4 months ago by Jeff Grandjean (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
First off, adultery whether it happened or not is not something that a judge will take into consideratin when dividing property.  Taken alone, yes your soon to be ex could force a sale of the car if you cannot get him off the loan, but there are likely several other property and debt issues present, and a good divorce attorney could likely find a way to negotiate for you to keep your vehicle.  i would definitely recommend speaking to a divorce attorney, I practice in that area as do others here on Lawyers.com.... Is NM a fault or no fault state?

Answered 8 years and 4 months ago by Jeff Grandjean (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
New Mexico is what you would call a no-fault state since we allow divorces on the grounds of incompatibility, which basically means if one party wants a divorce, the divorce will happen.

I'm in the middle of a divorce and I feel my lawyer isn't on my side what can I do

Answered 8 years and 4 months ago by Jeff Grandjean (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
First of all, you always retain the option of changing attorneys if you are not satisfied with the work your current attorney is doing for you.  As far as how, your best bet is to contact some attorneys and set up a consultation to discuss your options, and if you find someone you like and can work out a fee arrangement, hire them and they will replace your current attorney.  I would recommend you actually find and hire a new attorney before releasing your current attorney, as you don't want to end up unrepresented.  Please feel free to contact me if you would like, or another lawyer on here.... How does one prepare for a family law hearing?

Answered 12 years and 9 months ago by Ms. Jessica M Cotter (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Divorce
There are many experienced family law attorneys who offer a consultation at a minimal cost, or for free. You should consider such a consultation. If there is a family law hearing set you should have received a document from the court called a minute entry. In that minute entry you should find information and deadlines for items that will be presented at the hearing. There is a deadline for you to disclose any documents you intend to present to the court at the hearing, and also a deadline and a procedure for you to deliver copies to the court.... Read More

Does any family law or divorce lawyer do alienation of affection?

Answered 13 years and 4 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Divorce
Alienation of affection has largely been abolished as a tort cause of action in the United States. Moreover, such lawsuits are disfavored and require proof of difficult facts. For the lawsuit to be successful, the defendant needs to have money and be capable of responding in damages. Some personal injury lawyers will take these cases on in states where the tort is recognized. Good luck.... Read More
