What do I do if I was charged with DUI marijuana but no evidence?

Answered 13 years and 2 months ago by Mr. George Lawrence Sandefer (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
You have raised a lot of issues.  The stop may be bad, the search may be bad, the arrest after passing exercises should be looked at closely.   You should contact an experienced criiminal and DUI attorney.  It sounds like your were arrested for either DUI, possession, or reckless driving or all 3.   You should not try to do this alone.  My advice would be to get an attorney in or near the county where this occurred or get an attorney where you live to coordinate this.  ... Am I looking at mandatory jail time on first dui with hitand run

Answered 13 years and 3 months ago by Mr. Russell Thomas Kirshy (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
It sounds like you have been arrested for two misdemeanor offenses.  While I don't believe there is any mandatory jail sentence required for these offenses, you should really speak to an experienced criminal defense attorney as soon as possible.  Some counties may want jail time due to the hit and run.  If this occurred in Lee, Hendry, Charlotte, Desoto, Sarasota or Manatee counties, you can call my office and I will be happy to discuss it with you.... If you did not complete your DUI class or pay your court fees, you may have a warrant for your arrest or a suspension on your license.  You really should call a criminal attorney in the county where this case arose to discuss it further.  If this occurred in Lee, Hendry, Charlotte, Desoto, Sarasota or Manatee counties, you can call my office and I will be happy to discuss it with you.  ... What is my next step besides turning myself in to jail without legal counsel?

Answered 13 years and 3 months ago by John J. Carney (Unclaimed Profile)   |   10 Answers   |  Legal Topics: DUI/DWI
If you commit a crime then you have to obey the order of the court or you will go to jail. The judge does not care if it is expensive or inconvenient, you either comply with the terms or you get a year in jail. You do not seem to realize the consequences of violating the judges order.

I got a DUI 5 years and 6 months ago. DuI have to put it on my application if they only ask about felonies?

Answered 13 years and 3 months ago by Michael Wynn (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
You need to consult an attorney. The first question is whether or not the DUI was a felony DUI or misdemeanor DUI? I cannot answer the question without first knowing which category the crime fits in. There are several ways to fall within the felony DUI category but your question does not give enough information to give a proper response.... Read More

If that is your only DUI Florida will require you to fulfill those obligations and prove to Colorado that you did them and Colorado will need to clear your license.  When they do, Florida should give you a license.  I would call your attorney in colorado to see how to do that. ... Read More

If your friend got a DUI in your car, can your car get inpounded?

Answered 13 years and 10 months ago by attorney Harley Ives Gutin   |   1 Answer   |  Legal Topics: DUI/DWI
That can happen. Typically on a DUI plea or conviction the Court orders that the car the defendant was driving be impounded for ten days as that is required under the law. Most judges will either waive that requirement or allow another car to be impounded. Impounded means not used for ten days. The impoundment of the car can be a company comes out and puts a lock on the car. If the car was impounded (literally) during the arrest then there could be other issues such as drugs found in the car or some other reason the car was impounded.... Read More

Yes. But you can go in front of the Judge and claim hardship. Most judges will waive it under your facts.

The police only have to read an accused their rights under Miranda when the person is 1.) under arrest and in custody and 2.) being questioned about a crime (that one or another one).  This response is general in nature and is not legal advice. No attorney client relationship is formed by it. Further, the response does not represent the opinions or views of LexisNexis or its affiliated companies.... Read More
