I doubt that your prior conviction was expunged through a diversion; diversion typically means that no conviction is entered in the first place. There are very precise rules for filing petitions to expunge, but it seems you would still be eligible. Attorneys charge differently for expungements. Because the process is fairly straight forward, you may want to look for a flat fee that works within your budget. However, you will also need to find out whether you can get the felony expunged at all based on your other convictions. Some states do not allow a person to have a conviction expunged if he or she has been convicted of more than one crime. You should contact an attorney licensed in Indiana to inquire further.

It may be possible to have that charged expunged so long as the law in Indiana allows such an offense to be expunged. Most states do not allow every single offense to be expunged. Also, if you have more than one conviction, that may restrict you from having the offense expunged. As I am not licensed in the state of Indiana, I strongly encourage you to consult with an attorney who is licensed to practice in that state.

I cannot say exactly what Indiana's expungement law requires but typically a misdemeanor can be expunged a year after the sentencing terms have been complied with. Expungements are also handled differently depending on whether you were convicted or the case was dismissed or there was a finding of not guilty. Because you entered into a diversion program that you then successfully completed, you were likely not convicted of anything. So your right to an expungement would be governed by the rules on dismissed cases. Your next step would be to contact the court where the charge was pending and ask about the process or contact an attorney licensed in the state of Indiana to walk you through the process.
