Can I sue my medical insurance

If your doctor wrote up the need for the MRI correctly and your insurance company pursuant to the contractual terms was required to do the MRI or that reasonably should have done so you do have a legal claim to sue the insurance company for the extra year of your pain and suffering. If the outcome of your surgery is the same regardless of when you had the MRI that would cut off your damages. The terms of your insurance policy will ultimately dictate if you have a lawsuit.... Your health insurance renewal would be governed by the language in the original contract you signed. Most contracts are not automatically renewable. If you are part of a larger group such as one provided by an employer you will have little say in the coverages you receive and the renewal options. If you brought Private health insurance you certainly have leverage until you have paid them. My suggestion is to talk to your agent if you have one or get a lawyer to review the language in the agreement. THe question that must be asked to determine if you have a claim is whether the neibor acted reasonably for the circumstances.  If there was no wind and no reason to expect one, they may not be resonsible.  If the opposite is true they would be responsible and you could sue them in small claims.  the ll/owner is not responsible unless you can show he knew or should have know what his tennant was doing or failed to do.... Obviously the Insurance company does not want to pay someone who can not prove he is the owner.  The owner can make another claim if they pay the worng person.  Also since they are actually paying to buy your car they want the title so that they can salvage the car.   If you dont have the titlte you can probably get oine from the DMV but you will have to go there and pay a small fee for a relacement title.  Good luck.... It doesn't matter if they closed the file.  You can bring a claim and sue for 2 years after the incident.  Tell them to open the claim.  If they don't you can sue.  Depending on the amount of the damage, small claims would be good up to $5000.  If your call doesn't work have a lawyer send them a demand....
