From the facts provided, it doesn't appear that you were at fault. Even if the dirt bike rider had some fault, the fact that there are serious injuries should not preclude you from seeking legal advice on your claim? What size was the truck?

While driving my motor Scotter @ 20 MPH the brake caliber fell out causing the rear wheel to jam and I fell off sustaining injuries. Can I sue?

Will insurance pay and can you get a DUI if injured in an accident (not my fault) when marijuana is found in the urine while at the hospital?

The other person's insurance will pay even though marijuana was found in your urine, as long as it was the other person's fault. How do we proceed when our car was hit by a moped? Moped driver does not have insurance so we are concerned about claiming this to our insurance co.

Your two choices are to go through your own insurance company which would leave the problem of collecting from the at fault driver their problem, or trying to collect from him yourself.
