How do I legally protect my idea for a new industrial bracket?

Answered 15 years and 3 months ago by Anthony H Handal (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Patents
To protect an idea, you need to file a patent. This will give you rights throughout the United States and a grace period within which to file overseas. You should not disclose your idea to anyone or publish or sell the product, as this may jeopardize your rights in the United States and is very likely to prevent you from seeking a patent in many countries outside the United States.... Will I be violating copyright laws if I have a professional music played in the background of my non-commercial film?

Answered 15 years and 4 months ago by Anthony H Handal (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Patents
I thought about this one a bit. Probably arguments could be made that this is a fair use. However the safer course of action would be to request permission from the publisher of the music. Asking permission might make your application more impressive.

What is a provisional patent application??

Answered 15 years and 4 months ago by Anthony H Handal (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Patents
A provisional patent application is an application for patent which is not examined and cannot issue into a patent. However, a regular non-provisional application can claim its filing date, and perhaps gain priority over later filed applications. A provisional application expires within one year and if the non-provisional is not filed, the rights which it creates expire. The cost of filing a provisional application is lower than the cost for a regular. This is because it does not include a set of claims detailing the proposed coverage of the patent, and carries a lower government filing fee. There are advantages for filing the non-provisional patent application shortly after filing the provisional application, such as expediting examination and allowance of a patent (if approved by the USPTO) and more economy in the procedure overall.... What are my options if I cannot afford utility pattent fees?

Answered 15 years and 4 months ago by Mr. Mark S Hubert (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Patents
What do you mean when you say standard fees. A patent attorney in LA may charge $15000 to file the same patent that an attorney in another state may charge $3500 to file. I suggest that you look at other states and other attorneys or patent agents (who generally tend to charge less). For example for a utility patent for a mechanical device I generally charge $4500 to $5500 including the drawings and filing fees.... Read More

Can I use ratios as measurements on a patent?

Answered 15 years and 4 months ago by Mr. Mark S Hubert (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Patents
Yes you can but I would recommend against it. Why not just explain in detail what it is. Referencing another device when you are trying to sell the novelty of you own invention is never a good idea - that is unless you can show some unexpected results that you obtain from those differences.... Paying a Fee

Answered 15 years and 5 months ago by Mr. Mark S Hubert (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Patents
It appears you want a guarantee that your idea will make you a fortune before you spend a dime. It doesn't work like that. If you believe in your idea then spend the money to protect it with a patent. However I would not spend one red cent to a company that promises to introduce your idea to the market and make you all sorts of money.... Read More

Can I get a date and time stamp online?

Answered 15 years and 5 months ago by Mr. Mark S Hubert (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Patents
I do not know of one. If you are trying to establish a first date of creation you could describe or photography the creation and mail it to yourself. When you get it do not open it. I heard that if you ask, the post office will date stamp upon request.
