I had a slip and fall back in Febuary of 2010,on my stairs of my apartment building! I currently have a lawyer working on my case. I received a phone call today from my lawyer, stating that the recorded statement that I have made with the defendents insurance company has "mysteriously" been lost. I was then asked to redo a recorded statement of what happened again, I think that this is not my problem at this point and i shouldnt have to repeat this again! Should I have to do this? My lawyer tells me that it could slow down the process of the case if I don't! I think this could be used as a rebuddle in court if it ever gets to this point. My lawyer told me that he did get in writing if they do find this "missing statement" they could not use this against me but I think it could hurt my case! Confused?

Most likely there is insurance involved and their attorney's are just following procedure.  You don't have to do anything, but it will certainly make your case take longer at the very least if you don't redo statement. These things happen, things do get lost. I don't see how they could use your statement against you, unless you tell a different story the second time. Joseph F. Botelho, Esq. I lost a brother to suicide a few years ago and recently found out a contributing factor was sexual abuse he suffered when he was an alterboy by his priest.Two friends of his were also abused by same priest.I don't know if they would testify to this or even if they did already but do you think I would have a case against the catholic priest who did this?

No you do not, unless your brother supported you, you have no legal standing; but the two friends may have a case. In order for someone to file a law suit against another they must first have what is called legal standing. In this case legal standing would be held by your brother, his wife, children and anyone who he supported in wrongful death suit. But as nothing was done directly to you, you can not bring suit against the priest. Your brother's estate may have a wrongful death suit, depending on the facts. I poured my orange juice from a half gallon of Simply Orange Juice into a small glass. Took a drink and felt something lodged in my throat.

allergic reaction to walnuts, asked if food had them and they replied no. Walnuts were in the food and had medical treatment and admitted tp hospital

Was this a restaurant or business that served you or a personas house. Was there walnuts in food or just used in same kitchen? Did you receive any damages, did any money come out of your pocket because of this (hospital bills, lost time at work, ect.....).
