Who will pay for the accident expenses and where to begin?

Answered 10 years and 10 months ago by Gregory M. Janks (Unclaimed Profile)   |   13 Answers   |  Legal Topics: Personal Injury
Since your question doesn't give any specifics as to the type of "accident", no specific advice can be given. In general, if it is a vehicle crash, then your own vehicle insurer pays all crash related medical care expenses (as long as you properly and timely notify them of the crash and submit proof of losses). If it is an on the job injury, the workers compensation insurer pays the treatment expenses (again with proper notice/proof). If it is some other type of "accident", then there may be some limited "med pay" coverage that will help with deductibles/out-of-pocket medical expenses (if you put the defendant on notice and they have available coverage and they report the loss). You'd be best to consult local counsel that regularly handles the type of claim you may have for a free consultation.... Read More

Who will pay for the accident expenses and where to begin?

Depends on the type of accident. In auto cases the at-fault party's insurance pays. In other type of cases depending on liability, you can have the at-fault party pay for your damages. I suggest that you hire a lawyer to handle this matter to accomplish the best results. Good Luck.

What kind of accident? You don't trust whom? If it's a car crash the answer is much different than if it's an on-the-job accident, so re-submit with some usable information.

Do I need to grant the insurance access to all of my medical records to collect? Why?

Answered 10 years and 10 months ago by Mr. Matthew D Kaplan (Unclaimed Profile)   |   15 Answers   |  Legal Topics: Personal Injury
All of your medical bills should be paid by your insurance company (PIP) and not the at fault insurance. You do need to cooperate with your insurance company and give them access to injury related records. You do not have to allow the at fault driver's ins to see your records until you are ready to reach a settlement. If you have a significant injury, I suggest you retain an attorney.... Read More

Do I need to grant the insurance access to all of my medical records to collect? Why?

Answered 10 years and 10 months ago by Mr. Andrew Glen Rosenberg (Unclaimed Profile)   |   15 Answers   |  Legal Topics: Personal Injury
If you want to negotiate with the insurance company, they want to determine that your injuries are not from a prior condition. Typically, they are able to find out your prior medical records, accidents, etc from a separate data base system. However, you can refuse to give them your prior medical records but then they will probably give you a low offer of settlement.... Read More

Should my son file harassment, assault and battery charges, or a lawsuit after being beaten up at a bar? How?

Answered 10 years and 11 months ago by Georges Herman Shers (Unclaimed Profile)   |   12 Answers   |  Legal Topics: Personal Injury
It is the police, and not your son, who decide what criminal charges to arrest the others on. The DA then decides what charges to press. In addition, he should file a civil suit against the three men who beat him up, and perhaps the bartender and bar owner if they knew they were drunk and looking for a fight or were otherwise negligent. A person who is convicted of a felony that is the cause of a person's bodily injuries is also liable for the person's attorney fees. Speak to some personal injury attorneys to see what they can do; the interview should be free.... Read More

Can I sue my child's dentist for pulling out the wrong teeth?

Yes, I think you do have a potential malpractice case against the dentist for pulling out the wrong teeth of your child. The case potential is strengthened by the fact that he will have a hard time chewing food for the next 1-2 years until other molars come in. Contact an injury lawyer to discuss the potential case in a free evaluation. All the best to you and especially your son during this challenging time.... Read More

No. These things happen. Kids spill food sometimes, and there is no way the school could have prevented it. First degree burns are no big deal.

Do I have a personal injury case? Why or why not?

Answered 12 years and 2 months ago by Edwin K. Niles (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Personal Injury
Medical and dental malpractice claims are, by their nature, very difficult. Under California law, it is necessary, before filing suit, to obtain an affidavit from another professional, verifying that he has reviewed the medical charts and has found that there was negligence. This can cost several thousand dollars, and most attorneys expect that the client will cover this cost. Negligence could be defined as the failure to use REASONABLE care; not all bad outcomes are the result of negligence. You should also be aware that there is a cap on the amount of recovery for pain and suffering, thanks to the doctor lobby. Sometimes one has a good case theoretically, but the damages are too small to warrant a suit.... Read More
