Answered 12 years and 4 months ago by James Eugene Hasser (Unclaimed Profile)   |   19 Answers   |  Legal Topics: Personal Injury
You could if you wanted, but before I would talk with the insurance company or even a lawyer, I would do some research on the internet to see what free info is available to educate myself on how the system works. Good luck.

If you are in an auto accident and have a lawsuit pending and you die not from the accident, can your spouse take over the case?

Answered 12 years and 4 months ago by Eugene Ray Critchett (Unclaimed Profile)   |   11 Answers   |  Legal Topics: Personal Injury
If you die as the direct and proximate result of injuries you sustained in the collision/accident, someone can open an estate on your behalf and still pursue the claim. The beneficiaries could be your spouse, children etc. If you have serious injuries as the result of an accident and believe you or a loved one may pass away, you will want to meet with an attorney immediately to preserve evidence for the case.... Can I sue the dentist and have them pay for the surgery if I got a fractured jaw?

Answered 12 years and 4 months ago by Andrew Tyler Velonis (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Personal Injury
Dental malpractice cases are always difficult to prove, as well as expensive and time consuming. Extractions necessarily include a possibility of complications. It is possible that some of the injuries were unavoidable, though what we usually see is part of a broken tooth remaining, rather than a broken jaw. You will need an expert witness to examine your dental records to determine whether the original dentist failed to conform to accepted practice when he performed the extraction.... Read More

Is the hotel liable for any damages after I slipped on a towel in my hotel bathroom?

Probably not. The towel was probably visible, and so you needed to be careful. Besides, who put the towel on the floor?

Do I have a case for having a bad hand even after surgery?

Answered 12 years and 6 months ago by James Eugene Hasser (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
It depends on whether the trailer court was at fault for your fall. You don't give enough facts to determine that. Good luck.

Do I have a case for having a bad hand even after surgery?

Answered 12 years and 6 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
If you can prove that the surgeon committed medical malpractice, then you can sue the doctor. However, if the actual accident CAUSED the problem and he did the best he could and you just have a residual problem, then you cannot sue for malpractice. If you can prove that the trailer park violated a duty owed to you, to provide you with reasonably safe common areas. and that was the direct cause of your accident and injuries, then you should sue the trailer park.... Do I have a case for having a bad hand even after surgery?

Answered 12 years and 6 months ago by Andrew Tyler Velonis (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
It is common that screws and plates need to be removed from a fracture site. There is no guarantee that the surgeon would have been able to repair the hand, particularly since we don't know how bad the fracture was to begin with. Also, accidents which cause fractures often cause other injuries as well, such as a tear of the "TFCC" which is connective tissue that holds many small bones in place. So, on the information provided, there isn't anything to indicate malpractice to me. Only if another doctor says that the surgeon made a mistake would you have something to go on.... Read More

Medical malpractice cases are extremely difficult. The only way to answer your question is to have your hand and your records reviewed by another hand specialist. No attorney will take your case without that review.

Should I be responsible for the medical bills incurred since the first doctor wasnโ€™t able to do the job well?

Answered 12 years and 7 months ago by Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Personal Injury
What you describe appears to be a viable claim for medical malpractice. If you will prove that the emergency treatment was due to the first physician's failure to provide proper care, he/she will be liable not only for all medical costs, but for your lost wages, pain and suffering, and all other damages caused by the deficient colonoscopy. I would recommend talking to a medical malpractice/personal injury attorney soon.... Read More

Technically, yes but it would be very interesting to refuse to pay and then when the doc sues you, interpose breach of contract as an affirmative defense. Pardon the technical language, but I've seen this type of question before and I wonder what would happen if someone in your position said "I won't pay you because you did a lousey job." We do this with tradesman and other professionals, why not doctors?... Read More

Medical question not a legal one. Medical care is not a guarantee of success. Sometimes things just don't go right. see what your dr says about it.

What you are asking, whether you know it or not, is whether the first Dr committed malpractice. That will take an expert opinion to get in the courthouse. However, your injuries probably won't justify the cost of bringing a claim. Get with your insurance company and see what they have to say also consider consulting with your current Dr for his or her opinion. Good luck.... Read More

There is a pending settlement for personal injury case but the plaintiff died. What happens to the case?

Answered 12 years and 7 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   14 Answers   |  Legal Topics: Personal Injury
If the case was, in fact, settled, then the money must be processed through the probate court for the county. If it was NOT settled, then it is possible that the case would have died with the deceased unless a deposition was taken to preserve the testimony. If the death was as a direct result of injuries sustained in the accident, then the case becomes one of a Wrongful Death claim, which can be worth a ton of money.... Read More
