If you failed to complete all of the requirements of probation, that is a violation of probation. The Prosecutor will file a motion to revoke your probation. There will be a hearing before a judge, who will decide whether to revoke your probation and sentence you for the original sentence. Expungement depends upon your total criminal record and any other convictions which you may have. Generally, at least in Michigan, you cannot have a charge expunged until five years have passed following the completion of your sentence, which in this case is two years probation.

If you plead guilty to "Driving While Suspended," 12 points will be added to your Missouri driving record and your license will be revoked for 1 year. If you hire an attorney to represent you, your attorney can get your "Driving While Suspended" ticket reduced to a non-moving, no-point violation that won't affect your driving record or insurance rates. You will have to show proof that your license has been reinstated. To get reinstated, you will have to pay a reinstatement fee to the Missouri Dept. of Revenue (Dept. of Motor Vehicles) and there may be other requirements. You can't get your license reinstated if you have any outstanding unpaid traffic tickets. I suggest you call the Missouri Dept. of Revenue to ask if you are eligible for reinstatement of your license and also ask what you have to do to get reinstated.... Read More

You would be able to challenge this DWI based on both the officers probable cause as well as his lack of blood / breath sample. It is important to note that the officer issuing a citation does not mean that you are going to be charged the DWI. The prosecutor will be the one to file the actual charges. Depending on the officer's report, the prosecutor could choose not to issue the citation. The license revocation is also very challengable because of a lack of probable cause.
