How long does an attorney have to give you your money from a settlement

Answered 2 years and 5 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Car Accident
Your lawyer needs to provide you with an itemized breakdown of all disbursements from the settlement proceeds. Sometimes delays occur when counsel and your medical providers are negotiating the price of their respective liens or letters of protection. If you have any Medicaid or Medicare liens, it usually takes much longer than 2 months. Ask him why is it taking so long and if he can't give you a sensible response, then file a complaint against him with the State bar of Arizona. ... Read More

lack of communication from accident attorney

Answered 10 years and a month ago by Mr. Freddy A Saavedra (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
Personal Injury cases tend to take a long time and communication is key to a good relationship between the client and the attorney. If you are concerned about the communications with your attorney I would first recommend bringing the concern up to the attorney, then if you are not satisfifed or the issue is not addressed schedule a consult with another attorney to see if they are willing to take your case.... John Bisnar The quickest and easiest way to deal with your insurance company to get your car repaired or paid for if it is a total loss is to get them a copy of the traffic collision report.   This is specially true in hit-and-run situations. This is a common problem that people in your situation have.  It is unfortunate that your insurance company isn't already looking at your car regardless of the traffic collision report.  Normally if you have rental car coverage your insurance company would be quicker to access your car because they don't want to pay any more rental car bills than they need too. You are lucky that the traffic collision report is only going to take a week.  There are jurisdictions where it is taking as much as six months to get a routine traffic collision report. I was rear ended by 2 cars. 1st car behind me had the most impact on my car and myself. The 3rd car did not have an insurance.

Answered 13 years and 10 months ago by John Paul Bisnar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
John Bisnar You have more problems with this case than you know.  Your best bet is to consult with a skilled personal injury attorney in Arizona that is also skilled in cases involving a workers' compensation component, as soon as you possibly can.  I'd suggest before you accept what sounds like an unfair deal on your car. For the damage to your car, you should be receiving he full amount it will cost to properly repair it.  You should also be getting reimbursed for the cost of renting an appropriate rental car and/or paid for the non-use of your car. Yes, you will wind up paying your personal injury attorney a fee.  However, there shouldn't be a circumstance where you are not recovering something for you if you were injured.  The best personal injury law firms are not going to charge you costs if they don't win your case. You haven't mentioned that your workers' compensation insurance company is going to want to be reimbursed, from your personal injury settlement, for anything they have paid out on your behalf. I suggest going to the upper left hand corner of this page and clicking on the "Find a Lawyer" button.  This button will take you through the process of finding a Arizona personal injury attorney that can assist you. It is probably too late to do anything at this time.  You would have signed a release accepting the amount offered.  If you had a doubt, you should have brought it up and made this suggestion before you agreed to the amount. What settlement should i expect from a vehicle vs pedestrian incident?

Answered 14 years and 6 months ago by Mr. James Jenkins Mills (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
It is difficult to predict, as each case is different.  You are likely entitled to your medical bills, any lost wages that you incurred as a result of your injuries, plus some measure of "pain and suffering."  Depending on Arizona law, you may also be entitled to recover punitive damages since the party at fault was intoxicated.  However, typically insurance policies don't provide coverage for punitive damages, so you should have your attorney look into the matter and discuss it with you prior to settlement.  Good luck with the negotiations.... CAN I SUBMIT A LAWSUIT IF THE DRIVER OF THE CAR HAD A SUSPENDED LICENSE

Answered 14 years and 7 months ago by John Paul Bisnar (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
Yes.  The license status of a potential lawsuit defendant has no impact on your ability to file a lawsuit.  If they have no insurance, you may find it very difficult to collect however.
