My daughter has left her two boys with grandparents repeatedly. What can we do?

Answered 2 years and 3 months ago by Luis Ernesto Basagoitia (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Abuse And Neglect
Good afternoon, please contact the FL child abuse hotline. You can google it. You are required by law to report child abandonment to the child abuse hotline. The department of children and families will become involved and will take the necessary action including a court case if warranted. The children should be placed with you because you are the relatives and they are in good hands. I cannot guarantee the latter. If you want legal representaiton, contact the Florida Bar Lawyer Referral Service and ask for a Juvenile lawyer in your area.... Read More

what type of Lawyer do I need to get

Answered 3 years and 4 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Child Abuse And Neglect
If your daughter's domicile is your residence (even though she's going away to college), she would be considered a resident of your home, and thus your homeowners insurance policy may cover this incident. Turn the matter over to the your insurance carrier for defense and coverage.

Not sure whast you are asking, but this is likely to be something you will have to deal with if your son is involved with others unsupervise with various mental disabilities. There is no practical means to address others mistaking his conduct or actions. Thankfully, the prosecutor declines prosecution. ... Read More

Can I sue my adopted family for emotional distress and negligence

Answered 4 years and 2 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Child Abuse And Neglect
Yes, it is possible to sue a family member for sexual abuse that occurred during the period when you were a child. First there is a statute of limitations that applies to your case, and the statute of limitation is sometimes suspended until the age of 18, when it starts to run again. Secondly, insurance policies that would cover the negligent party that knew or should've known of the sexual abuse but failed to intervene to stop it, may provide a defense and coverage to that third-party, But those insurance policies Often times have an exclusion for a family member who permanently resides at the residence as opposed to a family member who is visiting that residence.. So if you were a part-time resident or living temporarily at that house,  there may be coverage that you could pursue. You should discuss your case with counsel in a private phone consultation regarding all the facts and circumstances. And finally, in order to have credibility, you should at least have some kind of evidence that you can produce that would support or corroborate the claims that you were making. For example did you ever tell another person about this abuse when it was happening? Did you keep a diary of what was going on? What evidence do you have that would corroborate your claims, other than your own he said she said evidence?... Read More

can a 16 and 20 year old date in Florida?

Answered 7 years and 7 months ago by Heather Cherepkai (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Abuse And Neglect
It is not the act of dating itself that is illegal, but the contact between the 16 year old and 20 year old that is not permissible and thus in a nutshell, the 20 year old should not engage in any relationship with a 16 year old.

If I were to fight a child neglect charge would that prolong me getting my girls back?

Answered 7 years and 8 months ago by Heather Cherepkai (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Abuse And Neglect
Unfortunately, these cases are based on more than just being a good parent.  You should have either been appointed an attorney for the DCF case or should seek to have representation as this is serious and could impact your parental rights in the future as well.  Typically, you can go to trial and dispute the allegations and still engage in services to get your children back.  You can ask for referrals for those things that DCF wants you to do to get your children back.  It will help you in the long run, because if you do not win at trial then you will be starting at the beginning and that will prolong the reunfication with the children. An attorney is very helpful and necesary in these cases.  ... Read More
