What can I do if my ex girlfriend is filling a petition to get full custody of our 9 month old son?

Answered 12 years and 4 months ago by Ms. Joanna Marie Mitchell (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Child Custody
If she has filed papers, it is best that you consult with an attorney as soon as possible. Your future relationship with your child depends on how the court rules, so you want to be certain that your rights are properly asserted and protected.

How does DWI affect a child custody cases?

Answered 12 years and 4 months ago by Suzanne H. Lombardi (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Child Custody
There is no way of knowing if there has ever been custody awarded under the circumstances that you describe because every case is so different. It is important that you go to court and get custody of your child. That way you can argue - and you have a good chance of winning - that the child should not be gone the weekend with someone with a clear alcohol problem. I would suggest that you stand your ground and I would do my best to get to the courthouse first. An attorney can help you with the procedural aspects and give you a better idea if they have all of the circumstances.... Read More

Do I have to let the mother see our teenager even she does not have visitation rights?

Answered 12 years and 4 months ago by Jack W. Abel (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Child Custody
No. If the mother has no court ordered visitation you do not need to provide visitation. Mom needs to file her own motion to establish visitation and, at that point, it is up to the court to determine what, if any, visitation is in the child's interests. From the non-legal side, you need to weigh the pros and cons to the child of not seeing her mother.... Read More

Answered 12 years and 5 months ago by Bruce Provda (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Child Custody
Well if his filing was so incorrect I'm not sure what your concern is. If he gets a hearing then you need to get an attorney and oppose him.

How can my under aged friend who's pregnant give me her baby without going to court?

Answered 12 years and 5 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
She can't. She might give you a durable power of attorney, but she can revoke that at any time. If you truly want the child, you will need to adopt it and that requires going to court.

Can I fight child support from my ex?

Answered 12 years and 5 months ago by William M Stoddard (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Child Custody
No, if you a child, you owe support. However, if she is drawing state benefits, you owed the state back, not her. You have the right to have the support determined on real income, not imputed (usually higher) and you have a right to any credits which might apply. Cooperation is always the best action in setting support and making sure you never give her cash, always a check or some way to prove you paid. Paying through the support registry is best. Also if you are the father, do you want a relationship with this child. Seek a parenting plan so you can keep in touch. Maybe you should be raising this child and having her owe your support.... If my child's dad signs the birth certificate, does he automatically have to pay child support?

Answered 12 years and 5 months ago by Ms. Jessica M Cotter (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Child Custody
In Arizona there will only be a child support order entered if the dad does not support your child, like by living with you and the child, or if you start collecting benefits through the State. That is what would occur whether or not he is on the birth certificate.

Can my sonโ€™s father keep him from me just because he doesn't like a friend of mine?

Answered 12 years and 5 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
You go to court and ask for a modification so that your schedule with your son is approved by a court. If he thinks the friend is bad, and can prove it, he may get the court to agree. On the other hand, if it is just a personality problem, he probably won't be able to keep your son from you when you take him to your friend's.... Read More

What are some possible outcomes of my custody case?

Answered 12 years and 5 months ago by Aaron W. Goren (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
The Court will establish legal custody, parenting time and support. The Court can either adopt your agreement, or make its own determinations based on what you describe regarding parenting time and statewide guidelines for support. From what you describe, supervised parenting time appears very appropriate. The arrangement you now have relates to parenting time. Parenting time will impact the support obligation, at least if there is overnight parenting time by the Father. A full blown custody/parenting time dispute should not cost the amount you state....
