Answered 12 years and 9 months ago by Mr. Richard David Peacock (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
In South Carolina, you could most likely take him to family court and seek a custody order regarding the custody situation with your child. This information should not be applied to this or any other situation. Further, you should consult with legal counsel prior to taking any action and\or inaction based upon this information.... What can I do if my wife won't leave the house?

Answered 12 years and 10 months ago by John F Brennan (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Child Custody
You clearly need counsel and to take your issues to the Court. She will not be allowed to destroy your (actually marital) property and who staying in the house will be a decision of the judge if you cannot agree.

How can I find out if I'm included in an order of protection?

Answered 12 years and 10 months ago by Michael Davis Moore (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
Find out the county in which the order of protection was obtained and go to the family court's clerk's office where the order potentially originated. If the order exists, the clerk of court should provide it to you. Since you are a minor, you should obtain the assistance of an attorney as the clerk may not provide the same directly to you but will likely insist on giving it directly to your legal custodian. Of course, I have only provided you with you with very general information which is not intended as legal advice. Hence, no one should rely and act upon my commentary, but instead should directly consult with a attorney of his or her choosing before taking any of the legal steps discussed. That being said, I am more than willing to consult with you if you desire further insight into how to pursue the present matter. I may be reached by phone at Moore Legal Solutions.... Read More

What are my chances as a father of getting joint custody?

Answered 12 years and 10 months ago by Ms. Joanna Marie Mitchell (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Child Custody
You need to consult with an attorney. In Florida, it is very common for Father's to have substantial time with their children and sometimes even equal time (or majority time, if the circumstances call for it). However, there are many factors that the court considers in determining what living situation is in the child's best interest, so you should consult with an attorney in order to best determine your potential rights and options.... Can I adopt kids that aren't blood related to me?

Answered 12 years and 11 months ago by attorney Brent R. Chipman   |   6 Answers   |  Legal Topics: Child Custody
Yes you can adopt children who are not blood relatives. In fact the vast majority of adoptions do not involve blood relatives. You must file a petition to adopt and either obtain the consent of the natural parents or have the court terminate their rights. You could also petition the court for a guardianship over the children.... Read More

How can I go about volunteer adoption of my grandchild?

Answered 13 years ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
Talk with the attorney that will handle the adoption. That is the only way to know how much it will cost.

I can't answer this question without more specific information about the parties and about your past issue; however, the fact that you were not convicted would be relevant. Further, the court would have to determine whether the children are at risk as a result of her relationship with you. I recommend she consult with an attorney to discuss the situation in greater detail.... Read More

What can be done if arrested under false pretenses/personal injury?

Answered 13 years and a month ago by Ronald A. Steinberg (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Child Custody
I suggest that you have your divorce lawyer bring to the court's attention all of the nonsense going on between you and your ex-husband. I cannot advise you about the arrest, but if you can get the post-divorce issues worked out, that may provide you with a defense to the arrest. As to the cops telling your kid to shut the hell up, I would write a letter to the police chief and complain. That is completely inappropriate to a child, under any circumstances.... Read More

What is a step moms legal rights?

Answered 13 years and 5 months ago by Anne Barbara Howard (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Child Custody
Go to court and get an order preventing her from signing as the parent. However, it sounds as if the father isn't stepping up to the plate and taking the child to the doctor, etc. so it's good someone is being responsible.

What is a step moms legal rights?

Answered 13 years and 5 months ago by Dennis P. Mikko (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Child Custody
A step parent has no rights to act on behalf of the child without the consent of a parent. Your husband should be signing instead of his girlfriend. You may want to make the school, doctor, etc. aware that the girlfriend is not a parent and has no right to act as one. If this were to continue and become a problem, you could file a motion with the Court seeking an order defining her rights, or lack thereof.... Read More

Non USA citizen pregnant visitor and don't have money for the childbirth costs. What can I do?

Answered 13 years and 7 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Child Custody
Well, you might be able to go into an emergency room. I don't know the impact of doing that before you actually go into labor. I do know that if you don't have proper prenatal care, there is a good chance the baby is going to have problems. Do you have a green card? If not, you may have to go back to your country to deliver the baby. It is hard to give you an answer without my personal biases creeping into this. A child does not ask to be born. So, if you allow yourself to get pregnant, I think that you assume the responsibility to give that baby the best possible chance at a normal, healthy life. I also think that you assume the responsibility to give that baby the best possible education and/or training skills so that it can become a self-sufficient, responsible adult. Anything less is a breach of that parental responsibility.... Read More

Go back to your native land if it provides free health coverage. Otherwise go to the emergency room of a public hospital when you go into labor.

Just do what any other illegal alien does. Wait until full term labor begins, and go to an emergency room.
