You must file a police report to make a claim with the bank.  His credit will not be impacted, but if he is found to be responsible, there is something called Checksystems, which is like a credit report for bank accounts and he might not get another bank account at another bank.

If you blocked the account so no more payments can be deducted, that is fine.  If what you did was not suficient, close this account and open another.  I cannot imagine how much money is involved, but if a few dollars just chalk it up to life experience.  If more, you can call the NYS Attorney General and make a complaint, but do not count on any results.... You can.  Sometimes people only settle if you sue them.  A letter from a lawyer might be helpful.

What is considered consumer fraud. I know of a 99 cents store in my neighborhood that charges 10% for tax,always has, as oppose to the 8.75%.

This phone message is a scam, and has nothing to do with the earlier event.  If you follow the message, the scammers get you to disclose your PIN and card number.  This is a coincidence that there was another issue the year before.
