I am not sure what your question is. If you are the beneficiary on the life insurance, it will go to you, Will or not. Does your father have other assets in his name alone? If he does not, then a Will would not make any difference. If all of his assets are joint or have a designated beneficiary, then they will pass to the joint owner or beneficiary. Probate will not be necessary and neither is a Will. Your father should have a durable power of attorney for medical and financial affairs. If he does, then he may be all set. You should first of all make sure to secure the services of a local criminal defense attorney to ensure that your case is being handled properly. While it should not necessarily be a problem for your daughter to leave the state with you pending her court date, you can ensure that this is the case by having your attorney file a Motion to Leave the Jurisdiction which, if approved, will grant you permission to take her out of the state with you until returning for her court date. You probably don't have the money to hire one right now. Unless you plan on getting a sudden influx of cash, you may want to re-think the plan of putting the court off over and over.
