If you can't afford an attorney the Court will appoint a public defender to represent you. ?They are often overworked and underpaid but many of them are very good lawyers. ?Make sure they know of your mental issues. ?It could help to get the charges dismissed or reduced.

Can I face jail time for a misdemeanor theft of only fifteen dollars?

Answered 12 years and 5 months ago by Robert Michael McHale, Jr (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
Technically yes. Realistically no! For a crime like that you are most likely looking at a possible fine and maybe some probation. I would ask if you are sentenced that you be sentenced under Article 894 which means if you don't get in any trouble for a year you can have it removed from your record.... Read More

What will happen if I did not show up with the narcotic agent on our meeting?

I would not contact the agents. If they use you as a CI they will put you in danger. They may come back and try to charge you. But they would probably do that after they had used you as a CI. I would contact a lawyer immediately.

What would show up in police clearance certificate?

Answered 12 years and 7 months ago by Paul J. Carmouche (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
The arrest will still show. You will need to file a motion to expunge the record. In today's high tech society, once the arrest is put in the data base it will not go away until a Judge orders it removed from the prosecutor's records; police; State Police records and the FBI records

If I was arrested for disorderly conduct, do the police have to read me my Miranda rights?

Answered 12 years and 8 months ago by Francis John Cowhig (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Criminal Defense
No. Although an officer should read you your Miranda rights when you are arrested, it is not absolutely necessary as long as you are not questioned about the crime for which you were arrested or were detained during the questioning. Miranda only acts to suppress any statements you gave the police after you are arrested or detained. It does not invalidate an arrest.... Read More

What can I do about my Dad's insurance?

Answered 12 years and 9 months ago by James P Frederick (Unclaimed Profile)   |   11 Answers   |  Legal Topics: Criminal Defense
I am not sure what your question is. If you are the beneficiary on the life insurance, it will go to you, Will or not. Does your father have other assets in his name alone? If he does not, then a Will would not make any difference. If all of his assets are joint or have a designated beneficiary, then they will pass to the joint owner or beneficiary. Probate will not be necessary and neither is a Will. Your father should have a durable power of attorney for medical and financial affairs. If he does, then he may be all set. He should see an estate planning attorney to make sure. Many of us do not charge for an initial consulation.... Read More

What can I do about my Dad's insurance?

Answered 12 years and 9 months ago by Jayne L. Sebby (Unclaimed Profile)   |   11 Answers   |  Legal Topics: Criminal Defense
The assets of a person who dies without a will are distributed according to the statutes of the state in which the deceased lived. Usually, the beneficiary order is: surviving spouse and living children by birth or adoption, then living grandchildren, great-grand children, etc. Usually the proceeds of a life insurance policy are not considered part of the estate but go directly to the named beneficiary. If you provide more than room and board for your father, you may be entitled to payment for certain kinds of skilled and semi-skilled care you give.... Read More

What can I do about my Dad's insurance?

Answered 12 years and 9 months ago by Sanford M. Martin (Unclaimed Profile)   |   11 Answers   |  Legal Topics: Criminal Defense
Realize that if a life insurance policy designates you as beneficiary, whether he has a will makes no difference. Even if he has a will and leaves everything to others, you still receive the life insurance benefits. Of course, you should be aware of such legal issues and understand what is important regarding a will. Whether he even needs a will depend on his other assets, debts, and to whom he would like to give property. Also, if his mental soundness is suspect, he may not be competent to execute a will.... If you are the named beneficiary on your father's life insurance policy, then the policy will pay you when he passes away. You should know, though, that the state may have a claim for repayment of benefits that he received. There isn't anything you can do about that claim, just a heads up.
