Annulment is very hard to obtain and only appropriate in very specific situations, where for example there has been fraud or incapacity of one party. You do need for the other spouse to agree to a divorce. FL is a no fault state, all you need to allege is that the marriage is irretrievably broken and that the divorcing spouse has been a residence of the state of FL for 6 months prior to filing for divorce.   Best of Luck, Helena Y. How you get divorced is by filing a petition for dissolution of marriage. You have to at least attempt to have her served properly with a copy of the petition and a summons, and you have to make diligent search and inquiry about what you have done to try to locate her. However, any other affirmative relief like division of assets or alimony, would need to proceed in NC, unless your husband has lived in FL or has other significant connections with FL.   You do not state whether you have an order to pay child support or it is just paid voluntarily.  Also, understanding that you have been separated for 10 years you do not state whether there are any assets or liabilities to divide.  If there were not, then, but for the child, you could do the divorce in Florida...but all you could do is the divorce.  The proper jurisdiction to resolve the issues with the child (even if they are resolved between thetwo of you) is New York since that is where the child resides with the other parent.   Best of luck, Cindy Vova  ... It depends on the residence and notification requirements of that state.
