You will have to comply will all CA DMV requirements, and CA court requirements before re-issuance of a license. That generally means alcohol classes required by the court and enforced by DMV. If you have not yet settled the court case, that still remains an open issue. Yes, the state can do this. It is called a long form complaint and a summons is mailed to you. If you do not respond to the summons a warrant will be issued for your arrest.
