If I got a DUI in May 2005, should I report this on job applications even after I completed probation?

Answered 12 years and 2 months ago by Andrea Rogers (Unclaimed Profile)   |   7 Answers   |  Legal Topics: DUI/DWI
If you were actually convicted of the DUI, it will appear on a criminal background report. If you were given a suspended imposition of sentence (SIS) with probation, then if you successfully completed probation without any violations, there should be no conviction on your record. Applications for professional licensing often ask, "Have you ever pleaded guilty or been convicted of a criminal offense?" If so, the answer would be yes, you have pleaded guilty but you were not convicted. (With an SIS, you have to plead guilty to the original crime before the judge will suspend the sentence and put you on probation.)... Read More

How can a person transfer DUI classes to another state without actually transferring the case?

Answered 12 years and 7 months ago by Gregory Casale (Unclaimed Profile)   |   3 Answers   |  Legal Topics: DUI/DWI
The classes can be taken in another state so long as the program she wants to transfer to is similar in duration to the classes she is assigned to. Either on her own or with the assistance of her current probation officer she should look at the programs that the proposed state uses for 1st offense OUI classes. Get a brochure or something that details the classes as to duration and content and present that to her current probation officer. She will need approval of the court or probation to do this but it should not be a problem. I have had many clients that were charged in MA but did the 1st offender program in another state. She could also contact the lawyer who handled the OUI for her to assist. It shouldn't take more than a phone call or two by the lawyer to help her out.... Read More
