How likely am I to get my license reinstated if I have 4 DUI convictions?

Answered 9 years and 10 months ago by attorney Jason William Savela   |   1 Answer   |  Legal Topics: DUI/DWI
In Colorado, after 3 DUI convictions, they are not required to give you a DL, but normally they will. It helps to have proof of completion of classes for the last DUI. Since these were so long ago, it is less likely that you will have to get an interlock, but it is possible. I can help.

What are we looking at as far as punishment for a DUI probation violation?

Answered 10 years and 5 months ago by attorney Jason William Savela   |   1 Answer   |  Legal Topics: DUI/DWI
It sounds like your fiance has nearly completed everything. Keep that up. The new charges are probation violations. Getting them fixed the right way will solve the probation violation. For example, if charged with Driving Under Suspension, but only convicted of speeding or some other lesser charge, then likely no prob revo. Also, if fiance pleads guilty to a moving violation when he was suspended, it suspends him for a year even if the DUS is not a conviction. Beware.... Read More

Will we have to put an IID on both my cars? How?

Answered 10 years and 7 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   3 Answers   |  Legal Topics: DUI/DWI
Consult your own lawyer, or call the prosecutor. I believe that some agreements have been made whereby only the car driven by the defendant is required to have the IID, but those were several years ago. I doubt that transferring ownership to avoid the requirement will help: in fact, it will smell decidedly 'fishy.'... Read More

If I blew a .08 and a .07 and got a DUI, can I do something?

Answered 10 years and 8 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   8 Answers   |  Legal Topics: DUI/DWI
You would benefit from having a lawyer, but you could wait until you receive a summons with a copy of the complaint. They cannot charge you for having a Prohibited Alcohol Concentration, but they could still charge you with drunk driving, and use any test result above .04 as evidence. There are some defenses, however, which a good lawyer could tell yo.... Read More

Could I be arrested for DUI if I was sleeping in my car? How?

Answered 10 years and 11 months ago by Francis John Cowhig (Unclaimed Profile)   |   14 Answers   |  Legal Topics: DUI/DWI
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. How did your car get to the parking garage? Did you park there before you went to the bar? Do you have any witnesses who can prove that you did not drive your car to the garage after you had been drinking? Since we do not have all the facts, it is impossible to give a completely accurate answers. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. (S)he would then be in a better position to analyze your case and advise you of your options.... Read More

Is it legal to be arrested in the passenger seat of someone elseโ€™s car for DUI?

Answered 10 years and 11 months ago by attorney Jason William Savela   |   1 Answer   |  Legal Topics: DUI/DWI
That could be a good case. It depends on the evidence connecting you and your friends car to the minor accident. Time and distance plus whether a witness can put you there etc. If there is evidence to connect the car (or passengers of the car) driving away from scene of accident to accident, then likely can pull over and investigate, including arrest.... Well, he has to clear up the warrant. It would be good if he could get back into compliance too. Some judges give a day of jail for each hour of community service he has not done. Results depend on the judge and jurisdiction, but usually, they just want you to complete your classes, do community service and stay out of trouble. They may add some community service or a few days in jail if he is otherwise complete by sentencing.... Read More

Answered 11 years and 5 months ago by attorney Laurie A. Schmidt   |   1 Answer   |  Legal Topics: DUI/DWI
Depending on what the fines and fees were for, you may be eligible to convert some of the remaining balance to community service hours. You do need the permission of the judge in the county in which you were convicted, so it may require a trip back to Colorado.

Can I be charged with a DUI after the fact with no positive tests?

Answered 12 years ago by Michael J. Breczinski (Unclaimed Profile)   |   6 Answers   |  Legal Topics: DUI/DWI
It does not sound like they collected any evidence for such a charge, ( like breath or blood tests or field sobriety tests.) They probably will not do anything.
