The answer to your question is very dependent on the county in which she was charged. Some counties are much more lenient than others. In my home county of Gaston, a first offense misdemeanor larceny will usually be dismissed if the defendant completes some amount of community service. Having an attorney in this type of situation is very important because this is a discretionary decision on the prosecutor's part as to whether or not to drop the charge. Some states will not allow you to get a prior case expunged if you have a case currently pending. In that regard, it would be wise to take care of the current case. Once that is resolved, then you may be able to expunge the dismissed felony. You should contact an attorney licensed in North Carolina for more information. So long as your husband was not convicted of these offenses (including a not guilty verdict), he should be eligible for an expungement.
Expungements where the defendant was found not guilty are covered by North Carolina General Statute 15A-146.

An expunction is done in the state where the charge occurred. You would need to consult an attorney there to find out what could be expunged. NC has no provision for expunction of a felony conviction and in NC a felony conviction keeps you from getting a misdemeanor expunged.
