You are eligible for expungement if five years have passed since you were convicted AND you have not been arrested since. Talk with a good lawyer to get some information about eligibility and the process. Read the expungement page on my website. Lots of people do this without a lawyer and end up making a mess of it - doing part of it right is like building part of a bridge - it doesn't accomplish anything.

For purposes of your ability to possess or own firearms, any device designed to discharge or propel a bullet will be covered, so that includes the tactical, shotgun, and rifles in your grandfather's collection. I can help you figure out what to do with them. You may be able to expunge if you got ARD, but if you were convicted you will likely need to wait until you either turn 70 or get a governor's pardon. Don't forget that Federal Law also prohibits certain people from possessing firearms, and I would need to know the exact disposition of your case to advise you about that.

Most people don't realize this, but petty offenses generally are not handled in juvenile court even if the person is a juvenile, so the record is maintained and publicly available along with other records. The good news is that most if not all summaries are expungable. PennDOT has taken the position that traffic offenses aren't, but I think many Judges will disagree with them on that. You need to consult a lawyer to check whether you were convicted of a statutory crime or a local ordinance and then try to expunge the record. There is probably not any way that you can directly expunge your record. However, if you can obtain a pardon you would then be able to get it expunged. Pardons are very difficult to obtain and it takes a long time. Consult with a good lawyer just in case there is another way. You should try to file a nunc pro tunc appeal. This basically means a late appeal, which can be permitted where there was a breakdown in the court system. Find a good lawyer to help you with it.
