You need to give them a 30 day notice to vacate, no reason need be given. You should consult a landlord/tenant attorney to advise you how to proceed with the eviction.

I'm frankly not sure what you're talking about. If you feel you're being overcharged and living with hostile people, why don't you just move? Otherwise, it is not "illegal" to charge high rent. If it's too high, presumably no one will pay it. As far as your roommate shoving you, don't start a fight- you may end up in the hospital or jail. Instead, warn the person that you consider being shoved an assault, and call the police if you are shoved again. Really, though, you should just plan on leaving- It doesn't sound like a good situation.... Read More

There's nothing to "do" if threatened with being taken to small claims court. Either your friend will be sued or he won't. Good luck.

What are my rights against a roommate who broke the leas and left all her things?

Answered 13 years and 4 months ago by Francis John Cowhig (Unclaimed Profile)   |   3 Answers
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced landlord/tenant attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.... Read More

If the remaining heirs wonโ€™t sign a quit claim are they responsible for expenses for all those years?

Answered 13 years and 4 months ago by Richard Eldon Blasco (Unclaimed Profile)   |   5 Answers
Generally, your mother paying the expenses of the home will be treated as the equivalent of "rent" for the use of the home which is owned by multiple parties. Again, the answer to this question is dependent upon how title was held by the children grantees. Finally, you mother may be able to establish ownership of the property, and therefore title by adverse possession. However, again, the answer to this approach is dependent upon additional facts being known.... Read More

How can I collect a judgement I won against a former landlord who is Judgement Proof.?

Answered 13 years and 8 months ago by Mr. Richard Alan Alsobrook (Unclaimed Profile)   |   1 Answer
You may need to consider hiring a collections agency or collections law firm to collect on the judgement.  Depending on several factors, you may also have the option to file for garnishment of the landlord's assets.  You should contact a local attorney to determine how best to proceed. This is not intended to be legal advice, and is general in its nature. No attorney-client relationship exists or is formed by this information. Furthermore, this does not represent the views or opinions of LexisNexis or its affiliated companies.... Read More

You should consult with a landlord-tenant attorney regarding your rights as a tenant. They vary greatly from state to state. If you are in a tenant-friendly state like Massachusetts, you could call the local health department or another local agency overseeing the conditions of residential rental properties. You may also have a cause of action against your landlord for injuries sustained.... Read More

Answered 14 years and 5 months ago by Neil M. Kerstein (Unclaimed Profile)   |   1 Answer
If your Aunt knows about the Title V problem and is still willing to buy the property, you can sell it to your Aunt. However, your Aunt will not be able to get a mortgage or sell the property to any third party who needs financing until the septic system passes Title V. I suggest that you and your Aunt consult with an attorney at your earliest convenience.... Read More
