What can be done legally if a nursing home social worker is playing doctor?

Yes, they are making sure that the nursing home speaks with only one voice. However, if I were her, I would not answer your questions unless the man had given you a medical power of attorney to discuss his situation.

From what I read here, I'm not impressed. I don't have a dog in this fight and it looks to me like the social worker is trying to allow the nursing home to function in an orderly manner.

Would a waiver of liability even matter if there was an accident and the client sued me?

Answered 12 years ago by Ronald A. Steinberg (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
You need to talk to the owner of your company. The owner of a car is liable for causing an accident. The company that employs that owner would be liable if the accident occurred during the course and scope of the employment, but you would still be liable as the driver. You need to see the waiver of liability and you need a copy of it for your own records.... Read More

I don't know if a waiver would stand up in that circumstance, as to either you or your employer. However, you have insurance on your car and your employer undoubtedly has coverage under a general comprehensive liability policy.

Can I sue the landlord if after receiving the eviction letter, my landlord harassed me and my kids over and over?

Answered 12 years ago by James Eugene Hasser (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Personal Injury
Sure, but I don't know what the case would be worth because the damages are mainly non-economic. You would probably have to hire a lawyer by the hour to handle the case. It may be cheaper for you to move. Consult a lawyer that does eviction cases for their opinion.

What can I do if I am the victim of a hit and run with property damage and injuries?

Answered 12 years ago by Robert Andrew Morrin (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Personal Injury
Typically, the insurance follows the vehicle but most insurance policies only apply to those who use the vehicle with the owner's permission and theft would not be covered. In such a case you have acted correctly in putting in an uninsured insurance claim with your insurance carrier and they must respond within a reasonable time. If they deny it they must explain why. You should stay on the law enforcement agency that handled the wreck to produce the report. I suggest you sign nothing unless you have an attorney look at it first. It's often better to have an attorney communicate with the insurance companies on your behalf.... Read More

What can I do if I am the victim of a hit and run with property damage and injuries?

Answered 12 years ago by Gregory M Janks (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Personal Injury
In Michigan you are responsible to provide collision coverage on your own vehicle if you do not want to bear the loss. You are able to collect up to $1,000 in uninsured loss for collision damage from the at fault driver and/or their insurer under the mini-tort law. Perhaps there may be some type of claim against your insurance agent, although these are usually tough cases, if they failed to advise you that failure to carry collision coverage on your vehicle meant that you were personally bearing the risk of loss. In other words, this is a no fault state such that the fault of the other driver does not matter in regards to collision damage, medical expenses, wage loss and replacement services - all of which are covered by your own insurer.... The car thief is liable if you can ever find him or her. I am not sure Allstate will cover your car since the car was stolen. For there to be coverage, the driver has to be driving with permission or the owner has to be negligent. I'm not sure leaving your keys in the car makes you negligent. Your UM should cover your injuries and your med pay coverage your medical payments up to the limits of coverage. That may be all you get out of it. Consider consulting an experienced injury lawyer.... Read More

Is this sexual harassment or grounds for legal action at all?

Answered 12 years ago by Robert Andrew Morrin (Unclaimed Profile)   |   8 Answers   |  Legal Topics: Personal Injury
Currently, there is no statewide protection from employment discrimination based upon an individual's sexual orientation. Some local governments have passed local ordinances that prohibit such conduct so whether or not you would be protected from such discrimination depends on your specific location. There is also the question of whether or not you have been discriminated against at all if only rude comments have been made. Please feel welcome to contact me if you need more information, are interested in representation, or if you just have a question. I hope this has helped and I wish you all the best.... Read More
