Fault isn't necessarily all or none in every situation. There can be joint fault. Based on your explanation the fellow who didn't have operative brake lights would have some fault for not keeping his vehicle in proper operating condition so you would've been warned he was stopped. You'd likely share some fault for not operating your vehicle so you could stop within the assured clear distance ahead (a defense by you would be a sudden emergency created by the lack of operative brake lights on the vehicle ahead). If the DMV attempts to do so, you can probably request a hearing to explain that you are having a bad year. However, they may not buy that excuse. You need to have your medical records reviewed, and you need to be examined by an an independent expert in the field of plastic surgery. That expert should be able to say whether the care and treatment you received fell below the standard of care, that is was negligent. I cannot give you a definitive answer to your question as to whether you can "go back" and refuse to settle after signing a mediation agreement. To answer the question a lot more information would be needed including, but not limited to: what the mediation agreement specifically says; does the release include any significant differences from what was agreed to in the mediation agreement; and why some of your medical bills were not included as part of the settlement. Generally, a mediation agreement is an enforceable agreement and you are bound by its terms. If you refuse to sign the release the other side can go to court and ask the Court to have the mediation agreement enforced. However, as noted, this is the general rule. There are some exceptions and you might be able to void the mediation agreement. Without knowing more about your case, the mediation agreement and the release, I cannot comment whether you are bound by the mediation agreement. I would strongly suggest talking to your attorney about why your other bills were not included and whether there is a way to void the mediation agreement and permit you to receive more money.... You should, in writing, ask your ex-girlfriend to stop telling people you have herpes. This is a possible necessary step in a case against her. You mention "slander" in the additional information you provided. Slander is "oral" defamation while libel is "written" defamation. You do not indicate whether you do in fact have herpes. If you do, you do not have a defamation case as "truth" is a defense to defamation. Even if you do have herpes, you might also have breach of privacy claim under Nebraska law for either "trespassing or intruding upon a person's solitude" or "placing a person before the public in a false light." Finally, you might have a claim for either "intentional infliction of emotional distress" or "negligent infliction of emotional distress." You absolutely, unquestionably, have to see another dentist as soon as possible. First - and foremost - because your well-being depends on it. Living in such pain and letting your tooth rot is, simply, not reasonable. Second, because you would have to show to the court what your first dentist should have done; the best way to do it is to get proper care from a respectable professional. Third, because the longer you wait the better chances you give to the defendant dentist to say that, whatever the condition of your teeth you end up with by the time you got treatment, it has developed after you came to her (so, basically, she is not responsible - you are). Finally, any judge or jury deciding your case will have to weigh the faults: that pain that you have suffered, was it because the dentist did not treat you timely or because you did not go to another dentist as soon as it became clear that you were not receiving the right care from the defendant the tooth that you lost (and have to pay for an implant, or whatever, as a result), could it be saved if the defendant treated it right when you first came to see her - and could it be saved if you acted as a reasonable person and went to another dentist? Plainly speaking, the outcome of the case against this dentist will depend, to a large extent, on whether you act as a reasonable, responsible adult. Talk to your friends and co-workers: chances are, someone knows a really good dentist. Take care of your teeth, without any further delay.
