There is no specific legal requirement in Michigan that you have treatment within a certain amount of time following a car crash; however, you only have 1 year within which to submit a written application for No Fault Benefits and if you haven't submitted your Application timely, then any subsequent medical will NOT be covered (and in Michigan you are entitled to lifetime medical benefits for car crash related injuries). As to any 3rd party pain & suffering claim against any @ fault driver/owner, the longer you wait for treatment, the more likely they/their insurer/their lawyer will be to argue that your injuries were not serious and/or not related to the mvc. In Michigan the other insurer may NOT obtain any monies from you/your daughter if you were insured. Your insurer should defend you in any such claim as long as you have given them timely notice of same. Generally you may ask for an adjournment of a matter if you have a conflict, but your insurance company lawyer should be helping you/advising you. If the insurer won't get you a lawyer, get a detailed written reason from them as to the reason for their refusal and hire your own counsel to try and get this all straightened out.
