Who is at fault in the hit and run that I was involved in?

Answered 12 years and 10 months ago by Gregory M. Janks (Unclaimed Profile)   |   14 Answers   |  Legal Topics: Personal Injury
Fault isn't necessarily all or none in every situation. There can be joint fault. Based on your explanation the fellow who didn't have operative brake lights would have some fault for not keeping his vehicle in proper operating condition so you would've been warned he was stopped. You'd likely share some fault for not operating your vehicle so you could stop within the assured clear distance ahead (a defense by you would be a sudden emergency created by the lack of operative brake lights on the vehicle ahead). Perhaps others are also at fault? Why did the vehicle ahead have to stop? Was it a sudden stop? Why did the vehicles behind not stop? Etc.... Read More

What can my fiance' do if he found plastic beads in a bag of chips?

Answered 12 years and 10 months ago by Lisa Hurtado McDonnell (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Personal Injury
Well he would need to proof that the beads were in the bag. Did have any witnesses? Did he tell someone about the beads? He would need a dentist to testify that the beads cause the injury to his tooth.

There are occasions when L & I cases also permit suits against against a negligent third party. Ask your attorney if he or she thinks you have a third party case and get an explanation why or why not.

DMV has me on probation can I prevent my license from being suspended?

Answered 13 years ago by Alison Elle Aleman (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Personal Injury
If you keep making driving mistakes, especially numerous ones in one year, then yes, the DMV can suspend your license. If the DMV attempts to do so, you can probably request a hearing to explain that you are having a bad year. However, they may not buy that excuse. Perhaps there is are driving lessons you could offer to take so that the DMV would let you keep your license and continue on probation. You could offer that as a solution.... Read More

What can I do if I was working on a drilling rig in the oil field and I got hurt on the job and had to have knee surgery?

Answered 13 years and a month ago by Ronald A. Steinberg (Unclaimed Profile)   |   14 Answers   |  Legal Topics: Personal Injury
If you file a workers compensation case, you will not only get your lost wages, but they will also pay your medical bills. Those bills could run $10K to $25K. Your wages are small potatoes when you look at the medical bills. I would report the accident. I would not care if the company is unhappy, because I would be willing to bet that they will fire you when you return to work anyhow. You are now a liability because you could get hurt again.... Do I have legitimate cause for a lawsuit?

Answered 13 years and 2 months ago by Christian Joseph Menard (Unclaimed Profile)   |   14 Answers   |  Legal Topics: Personal Injury
You need to have your medical records reviewed, and you need to be examined by an an independent expert in the field of plastic surgery. That expert should be able to say whether the care and treatment you received fell below the standard of care, that is was negligent. If the expert's opinion was that there was negligence you probably have a case.... Read More

i was burned at gas pump do i have any right

Answered 13 years and 3 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You have a claim against the gas station.  You should contact a local personal injury attorney (one in your state).  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. You can use the "Find a Lawyer" service through this website to research personal injury attorneys. Then, visit each attorney's website and select a firm that has a record of successful verdicts. If you are unable to find a lawyer who meets these qualifications within your state, sometimes you may contact an out of state lawyer who can refer you to a qualified attorney in your state while providing support related to the issues of medicine. Click here and here for more information about me. Please note that by attempting to answer your question, I am not acting as your attorney. I will do nothing further to protect or preserve your interests in the absence of any additional discussion with you about this matter. John Ratkowitz, Esq. A mediation agreement was signed, can I go back on it and refuse due to settlement amount has changed since signed?

Answered 13 years and 6 months ago by Jeffrey B. Lapin (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Personal Injury
I cannot give you a definitive answer to your question as to whether you can "go back" and refuse to settle after signing a mediation agreement. To answer the question a lot more information would be needed including, but not limited to: what the mediation agreement specifically says; does the release include any significant differences from what was agreed to in the mediation agreement; and why some of your medical bills were not included as part of the settlement. Generally, a mediation agreement is an enforceable agreement and you are bound by its terms. If you refuse to sign the release the other side can go to court and ask the Court to have the mediation agreement enforced. However, as noted, this is the general rule. There are some exceptions and you might be able to void the mediation agreement. Without knowing more about your case, the mediation agreement and the release, I cannot comment whether you are bound by the mediation agreement. I would strongly suggest talking to your attorney about why your other bills were not included and whether there is a way to void the mediation agreement and permit you to receive more money.... Is NH the state with the law stating if my social security benefits are denied, my cash assistance "aptd" is closed?

Answered 13 years and 7 months ago by Jeffrey B. Lapin (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Personal Injury
Although you list "Nebraska" as the State, you mention. You do not mention "NH" which would be the abbreviation for New Hampshire. I am not licensed to practice law in New Hampshire and, as such, cannot answer questions involving New Hampshire law. Assuming you are asking about New Hampshire, you can re-ask your Question and select New Hampshire as the State. You might also considering calling a New Hampshire attorney. If you meant to type "NE", which is Nebraska's abbreviation, You list "Injury" as the Category but your case does not not involve an injury, at least from the information you provide. Moreover, I do not have any idea what "aptd" means. You may want to call Nebraska's Department of Health and Human Services and see if you can get an answer to your question.... Read More

How can I stop an ex-girlfriend from telling people I have herpes?

Answered 13 years and 7 months ago by Jeffrey B. Lapin (Unclaimed Profile)   |   27 Answers   |  Legal Topics: Personal Injury
You should, in writing, ask your ex-girlfriend to stop telling people you have herpes. This is a possible necessary step in a case against her. You mention "slander" in the additional information you provided. Slander is "oral" defamation while libel is "written" defamation. You do not indicate whether you do in fact have herpes. If you do, you do not have a defamation case as "truth" is a defense to defamation. Even if you do have herpes, you might also have breach of privacy claim under Nebraska law for either "trespassing or intruding upon a person's solitude" or "placing a person before the public in a false light." Finally, you might have a claim for either "intentional infliction of emotional distress" or "negligent infliction of emotional distress." I would suggest talking to an attorney to discuss your rights and options.... Read More

Can I sue my dentist and if so, how do I go about doing so?

Answered 13 years and 7 months ago by Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)   |   16 Answers   |  Legal Topics: Personal Injury
You absolutely, unquestionably, have to see another dentist as soon as possible. First - and foremost - because your well-being depends on it. Living in such pain and letting your tooth rot is, simply, not reasonable. Second, because you would have to show to the court what your first dentist should have done; the best way to do it is to get proper care from a respectable professional. Third, because the longer you wait the better chances you give to the defendant dentist to say that, whatever the condition of your teeth you end up with by the time you got treatment, it has developed after you came to her (so, basically, she is not responsible - you are). Finally, any judge or jury deciding your case will have to weigh the faults: that pain that you have suffered, was it because the dentist did not treat you timely or because you did not go to another dentist as soon as it became clear that you were not receiving the right care from the defendant the tooth that you lost (and have to pay for an implant, or whatever, as a result), could it be saved if the defendant treated it right when you first came to see her - and could it be saved if you acted as a reasonable person and went to another dentist? Plainly speaking, the outcome of the case against this dentist will depend, to a large extent, on whether you act as a reasonable, responsible adult. Talk to your friends and co-workers: chances are, someone knows a really good dentist. Take care of your teeth, without any further delay. Then, consult an attorney who knows how to prosecute dental malpractice claims. But first, for Pete's sake, go and get a good dentist look at your tooth!... Read More

Is refusal to pay court ordered workmen compensation a civil case?

Answered 13 years and 9 months ago by Michael Edmund Yeksavich (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
A valid Workers' Compensation Court judgment can be made a judgment of the District Court and enforced through the District Court as any civil judgment. Your daughter should retain an attorney to assist her, and I am surprised she does not have an attorney for the WC case.
