I can't answer your question, mostly because you're still treating for your injuries and no one will be able to give you intelligent input on your case value until you're either better, or recovered as much as you can.  For this reason, you shouldn't accept any money now-- if you do, your case will be over and you won't be able to go back and get more money if it turns out that you're permanently impaired.  Yes, you need to talk to a good, local personal injury lawyer, and I think you should do this right away.  It sounds as if you have already given a statement to the insurance company of the truck that hit you but if you haven't, don't until you talk to a lawyer. Yes they can. Fleeing the scene of an Automobile Accident is a criminal offence and has no bearing on a civil Personal Injury matter. If the Personal Injury case went all the way to trial, it may look badly, but fleeing an Automobile Accident isn't proof of guilt as to causing the accident. First, this question is best answered by your attorney.  Whenever you have questions about your on going lawsuit, consult the attorney who is representing you.  That's the attorney's job.  That's what he/she is there for. Second, the insurance company isn't the party that was negligent.  The insurance company did not do anything to injury you.  In this situation, the homeowner's insurance company doesn't have any responsibilities to you, that would come up in your lawsuit.  The insurance company has a duty to cover claims made against the homeowner.  So even though the homeowner's insurance company is likely to be paying any successful claim in your lawsuit, they are not a "party" to the lawsuit that should be named in the lawsuit.
