Does tn law require that the medical bills be paid from a settlement in a personal injury case if it is settled prior to going to court?

I would need a little more information since I am not sure what you mean by "the medical bills be paid" in your summary  because there are a variety of different ways that this can be handled. Sometimes when a person is injuried by the fault of another and incurrs medical bills, the medical provider will want to be paid our of the settlement since sometimes the injured person might not pay the medical provider from the settlement/judgment proceeds. In cases like this, the medical provider will request and obtain an assignment form where the injured person authorizes his/her attorney to withhold any money from the settlement and pay that money directly to the medical provider. This will be enforced whether it is obtained by settlement or judgment ("going to court"). ... Read More

Just because you fell does not make the hotel liable. You would have to establish that the ice and had been there for a sufficient length of time that they knew about it and failed to treat it. Since you did not get any medical treatment and will hopefully heal without any permanent injuries, the $1,000 that is offered is more on a nuisance offer to make you go away. Whether you want to take any offer is totally up to you but since filing a lawsuit is really not a viable option at this point and you do not want to go this route anyway, try and get as much from them as you can and then settle.... What you would need to do is to hire an attorney. Tennessee does have a victim compensation fund that you would need to file a claim with. As to the apartment complex, what the attorney will do is to conduct an investigation to find out more about the apartment complex, i.e. who owns it, what kind of security do they have, possbile past issues with security, etc. The attorney will also need to obtain information about the shooting itself, i.e. who were the shooters (if known), the reason for the shooting, the intended targets, etc. After gathering the above information, the attorney can then advise you on a possible lawsuit.... In Michigan your primary remedy for an on the job injury is workers compensation. You generally may not sue your employer for on the job injuries. The sole exception is if the employer "intended to injure you", which is a virtually insurmountable proof problem.
