You need to go back to the store immediately and take a photograph, actually take numerous photographs of the location where you fell. Photographs will show if there was anything defective about the sidewalk that put the store owner on actual or constructive notice that that area needed repairs to prevent an accident like the kind you suffered. I would do this immediately because otherwise they may repair it and then you won't have any evidence to show that they were negligent.... Read More

You are correct in noting that the statute of limitations in Texas for a personal injury case is two years. You need to hire an attorney as soon as possible. Many attorneys may not even take a case within 6 months of the statute of limitations. I have taken cases close to the limtiations deadline before. Most of the time it works out, but sometimes there are unknown problems that have to be worked out.
Additionally, slip and fall cases are some of the most challenging cases to handle. That is because the burden of proof is on the plaintiff to show that the property owner was negligent in creating or allowing a dangerous condition to exist on the property. Since the evidence necessary to prove your case is in the control of the property owner, I'm sure you can understand how this can pose some difficulty.
However, since your wife seems to have a very serious injury, then your case might seem appealing to an attorney. If you are looking for a personal injury attorney in the Dallas/Fort Worth area, I would be glad to talk to you and answer any questions you might have.... Read More

These types of cases are vigorously defended. Defendants can plead that the burden of proof is on the plaintiff to establish that the grocery store was on either actual or constructive notice of the dangerous condition and that they had enough time to mop the floor and/or put up warning signs. If liability can be established , then the value of your case would depend on the extent of your damages. Aside from your broken toe, do you have any other injuries that were caused by this accident? I would be happy to discuss your case with you at no charge. I am licensed and have offices in both Texas and Florida

You can sue them in civil court; obviously you'd need a lawyer to handle it for you. Depending upon your injuries, as well as some pertinent facts related to the soapy floor, you may be able to recover some money for your injuries. It's not a "rain maker," of a case, because slip and fall cases are generally pretty tough cases. But, if the facts are in your favor you may be able to win a settlement.... Read More
