In Wisconsin it is not entirely impossible, but it is very very hard. You would have to show that both parents are truly harmful to the child(ren). This would be an expensive proposition, probably requiring hiring a lawyer (which is a good idea in any court matter) and very likely an private investigator. Consult an experienced matrimonial lawyer in your area for advice and representation or at least to get some idea of how it is done in your neck of the woods and what it might involve in terms of costs.... The allocation of time with the children is part of the divorce. Custody is not at issue in WA, residential time and decision making authority is. Where there stuff is is irrelevant. As soon as one of you files a Petition for Dissolution, you can make a motion for temporary orders and get a temporary parenting plan and child support in place and have their stuff whereever they are the majority of time. If your cousin is legally competent, he can create a new power of attorney document that specifically terminates his previous POA and names you as his new agent. He should also notify anyone who has relied on the earlier document that it is no longer in effect and that his sister no longer has authority to act on his behalf. However, if he is not competent or the current POA has been approved by a court, he will not be able to change agents on his own.
