If you can't work it out with him you need to file a motion to adjudge him in contempt. To the extent that you can document his behavior you should because you will be more likely prevail with your motion if you have concrete proof to show the court. It's always difficult for a court when all they have to consider it two people's different versions of the same events.

In IL, a minor child is not allowed to make such an adult decision and the courts encourage you to foster a ongoing relationship with the noncustodial parent. In a nut shell, there is not much you can do, if any thing. You will probably be charged with driving while suspended. That will likely result in a lengthening of your suspension and further fines. In addition, you will not be able to get a license until you deal with any liability you may have for the accident or discharge that liability in bankrutpcy court.

In 2014, June 25 falls on Wednesday. So I assume that your vacation starts on July 25. The first Sunday is July 27 and the second consecutive Sunday is August 3, so she will need to be returned at 6:00 p.m. on August 3.

You need to give written notice so the father has a chance to object. Your husband is the child's legal father since you both perpetrated a fraud by putting his name on the birth certificate. If he signed the affidavit of paternity less than four years ago, he can go back and deny paternity. I think you need to address the issue of how you are going to support yourself especially if he is within the 4 year frame for denial. If he objects and makes a motion to the court, you will have to explain your reason for moving. In the absence of a job, there doesn't seem to be much of a reason.... Read More

If the whole decree was vacated, not just some part of it, then you do not have the capacity to marry since you are not divorced. That is very rare, so check to see what was actually vacated. Likely it was just some part impacting debts or assets.
