The law allows for the employer to make reasonable requests for documentation for cases of intermittent leave.  Part of this request would depend on the original documentation provided to the employer from your doctor which may explain why you would need to be off in the future. If you are going to see your doctor for each of your absences, it is probably safer to have a note from the doctor for these absences.  If some of your absences will be due to bed rest or some other complication that will not require you to see the doctor, then a single note from the doctor that this will be requried for the next several weeks should be sufficient. ... In Florida, an employer typically has the right to repayment of overpayment in wages. It is typically handled through deductions from future checks, including the last payroll check when employment terminates. Will the funds of his last check be adequate? I typically confront employees in these situations and obtain a release of claims against the employer as well as repayment. I also like to obtain a written acknowledgment of the extra deductions when possible.  Your question suggests that the employee knowingly submitted double hours (this is a form of embezzlement).  You may want to consider filing a police report if you believe that it truly  is embezzlement, or at least demanding full repayment  and a release of all claims he may have against the company from the employee in exchange for an agreement not to pursue criminal action. ... What a former employer tells a future employer is privileged, and may not be the subject of a suit, unless it is done with actual malice and knowledge.
