Will I have to pay for medical bills out of my settlement?

Answered 11 years and 6 months ago by John George Galasso (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
If you had an attorney represent you, then there probably is notice to your insurance company or dr for reinbursement; If you had no attorney and signed nothing with the medical providers, then they still will probably sue you for reinbursement, which would require you to pay medical bills and their attorney fees.... It sounds to me like your are asking for an extension to extend your statute of limitations beyond the expiration period, which appears to be July 30, 2014 based upon your question.  A statute of limtations is the amount of time you have to file a lawsuit against all responsible parties.  If you fail to file a lawsuit within this time limit against all responsible parties, your claim will be forever time barred and you will not be entitled to compensation.  Progressive should have advised you of this by letter.  For auto accidents, the statute of limtations is two years from the date of the accident.  Thus, you must file a lawsuit against all responsible parties no later than two years from the date of the accident, or your claim is barred. Generally speaking, there is no such thing as an extension to a statute of limitations, unless the person who caused the accident and any other responsible person would be willing to sign an agreement to extend the limitations period beyond the expiration date.  And I have never seen an automobile insurance company agree to extend the statute of limitations in my experience.  So what you need to do is find a lawyer ASAP who will take your case and file a lawsuit on your behalf no later than two years from the date of the accident.  Or you can file your own lawsuit, but it will need to filed against all responsible parties within two years of the accident, or your claim will be barred.  Go consult with a personal injury attorney in your area now.  Any delay could result in your claim being denied as untimely. Best of luck to you.... Read More

You can get it through the probate court. If an executor has been appointed, ask for the executor to sign the title. If not, ask for a court order.

Will my medical bills be taken out of my settlement before I receive it?

Answered 12 years and a month ago by Howard Dale Mishkind (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Your attorney should be able to answer that question for you. Depending on the amount of the medical bills and the liability issues, the jury may or may not award enough compensation to pay the attorney fees, cost of the case and your medical bills to make it worth your while. Sit down with your attorney and discuss the alternatives and then make an informed decision as to whether to accept the offer or go to trial. There is no right or wrong answer to your question and this is where the judgment of your attorney and your risk tolerance comes into play. Good luck.... Read More

What is the appropriate compensation for food allergy negligence?

Answered 12 years and 2 months ago by Mr. Paul L. Whitfield (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
First. I doubt if you can prove your case. do you have the products, gluten and no have you had them sent to a lab? Do you have experts to testify? You did not mention any medical opinions or medical bills, your emotions of the thing will mean nothing for you. Science and legal process are necessary to establish a decent claim. I don't sense that you are ready for any of that. they might offer to pay your medical bills if any. I would not think much beyond that. if I were their lawyer I am not sure I would pay you anything since you probably cant prove anything. Talk to a lawyer if you think you have a real claim for damages, not just feelings and emotions.... Read More

Can I still sue the hospital for malpractice after 3 years?

Answered 12 years and 3 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Personal Injury
First, miscarriages are common during the first trimester of pregnancy. Therefor, the fact that you had a miscarriage does not mean that anybody did anything wrong. Second, most EMS people (at least in Michigan) are protected by the doctrine of governmental immunity, so you can't sue. Third, under Michigan law, you can only sue within 2 years of the date on which malpractice occurred in such a case as what you are claiming.... Read More

You may have an action for damages due to their negligence and failure to follow instructions. I would also find another pizza parlor to deal with.

Buy your pizza elsewhere. If they are the only shop in town, make your own at home. It's very simple, and you'll enjoy it more knowing you have total control what you put on it. You can even make your own sauce so you know what goes into it. Life is too short to sweat fast food issues.

You have a workers compensation case. You could also sue the patient, but what he did is considered an intentional act, and it would not be covered under his homeowners insurance if he had any. You also could make a police report.
