Remember, you get what you pay for!  I'm not sure what you mean by a "cheap" lawyer, but it sounds as if you want to "make a deal."  It is not necessary. In Social Security Disability Insurance cases, there are no benefits paid for the first six (6) months after the disability began.  In SSI cases, there can be benefits in the first six (6) months: benefits are paid beginning the month after the Application is filed or the month after the disability began. However, to your rescue comes the "contingent" fee.  Contingent means "only if" the lawyer wins your case is she or he entitled to an attorney fee.  SSA has very strict regulations on attorneys and fees, and caps the fee at 25% of past due benefits or $6,000 - whichever is less.  These payments are after you are approved for disability. Capato.  The Court heard oral arguments in mid-March ... a decision should be issued by June 2012. If you go to this link you can locate an experienced professional in your location, or at least in your state.  If this doesn't work, I strongly recommend Legal Aid or the legal clinic of a Law School in your area or State. Unfortunately, you will not have a workers' compensation claim unless there was a physical injury that caused the anxiety and panic attacks.  If the co-worker attacked you, punched you, or caused some physical injury then you could have a workers' compensation case. In order to get Social Security Disability or SSI, you need to be able to prove your medical conditions will prevent you from returning to work for over one year.  If your doctors are willing to say your conditions are severe enough to prevent you from returning to work for over one year then you may be able to get SSDI or SSI.  I would need to get a lot more information to go over the specifics of your potential case. I would need a lot more information to give you a specific answer.  I need to know how Mary was set up as a guardian and why she was set up as the guardian.  Sometimes, Social Security requires a Claimant to get a guardian or someone to manage the SSDI or SSI checks.  I would need to know if a Power of Attorney or Legal Guardianship was set up.  If not, then this could just be a voluntary agreement which could be canceled at anytime by either party.  Shasta is allowed to set up a new account.  However, I am not sure how she would be allowed to set up the direct deposit to the new account without the Guardian's consent, especially if Power of Attorney or Legal Guardianship was done.  Mary needs to go to the bank and request copies of the documents that were filed in order to change the direct deposits.  The Bank will investigate fraud and could freeze the account and there were any irregularities.  Please visit our website for more information: http://workerscompfl.net/services/social-security/ Please call me for a FREE consultation at (877)817-4127. Often, it takes getting turned down once or twice before the Social Security Administration (SSA) finally gets it right. Your age is a relevant part of the determination, but so is one's work history. Anyone that works 21 years for the same company obviously is a hard worker and does not want to file for disability. However, your medical conditions have put you in that place. No requirement exists that a doctor "deem" you disabled before filing for Social Security Disability. In fact, in my practice, such "statements" are often deficient and not helpful to the eventual outcome of the case.
