Will I?

Answered 6 years and 3 months ago by attorney Terry Lynn Garrett   |   1 Answer   |  Legal Topics: Social Security Disability
SSDI, unike SSI, does not deduct for earned income.  However, there is a 9 month trial back to work period.  If you remain able to work after 9 months, you will be viewed as no longer disabled and lose SSDI.  If you again become disabled, you can again receive SSDI.

Am I still eligible for disability benefits?

Answered 6 years and 5 months ago by attorney Terry Lynn Garrett   |   1 Answer   |  Legal Topics: Social Security Disability
From your description, it is not clear why you were denied.  But it does appear that your lawyer appealed first to the administrative law judge and then to a district court.  Unless the district court's decision contained a mistake of law which was material and reversable, there is no further hope of appeal. However, you may well be eligible for Supplemental Security Income (SSI), food stamps (SNAP), the low income heat and assistance program (LIHEAP), and housing support such as HUD Section 8.  You may want to start by applying for Supplemental Security Income.  ... what does it mean to get a letter from the ssi of a decision

Answered 9 years and 8 months ago by attorney L. Carter Massengill   |   1 Answer   |  Legal Topics: Social Security Disability
You will need to read the letter carefully.  It means you were either approved or denied.  If you were denied you only have 60 days to file an appeal.  If you do not appeal it within the 60 day window, you would have to start a new claim from that day, thus losing out on potential backpay.  I recommend contacting an attorney to review the letter with you.  Many attorneys will provide free consultations.  ... will life insurance proceeds affect ssi payments

Answered 10 years and 3 months ago by Jessica Kurtz (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security Disability
SSI is based on income and resources. Life insurance policies with a combined face value of greater than $1,500 will count as a resource for SSI purposes. Cashing in your policy will likely affect your eligibility for SSI benefits.

Filed for Disability in January 2013 have not been denied or accepted.

Answered 12 years and 5 months ago by Mr. Richard Alan Alsobrook (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security Disability
If your situation is "dire," you have the option to request to expedite your case for dire need.  You would need to document your situation, however. If you are denied, you may want to consult a local disability attorney because a local attorney can review your case and assist in any appeals and/or hearings.  SSI and SSD cases before an ALJ or appeals can be nuanced and an experienced attorney may be able to increase your likelihood of success.  Most disability attorneys offer a free initial consultations. This is not intended to be legal advice, and is general in its nature. No attorney-client relationship exists or is formed by this information. My husband is 62 and has had 3 back surgerys and can not stand or walk far. What can we do to apply for disability.

Answered 14 years and 3 months ago by Michael J. Haller, Jr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Social Security Disability
From the facts you describe, your husband is still working. Depending on his income, he won't be able to apply until he stops working. I would recommend that you find an AV-rated lawyer in your area that is willing to work with you before you stop working and before you apply. Use the "Find a Lawyer" icon in the upper left of this page to assist you. It is important to have this planned out very carefully. If finding a local attorney doesn't work out, you can apply on your own online or go to your local office and apply.  Good luck to you.      ... Read More
