If your son was terminated because he complained about an illegal condition that could be a public health or safety hazard, he may be able to sue for his job back under the Whistleblower Statute. If he is in a protected class - minority, over age 40, different religion or nationality than everyone else on the job, etc. - he may have an action for illegal termination due to discrimination. ... Possible wrongful termination

Answered 9 years ago by attorney Lori Nevias   |   1 Answer   |  Legal Topics: Wrongful Termination
If the company policy you broke was to always spell and grammar check all of your correspondence before sending, I can't help you. There's no such word as "intergorated" (I guess you mean "interrogated"), and by "exceptions" I have to assume you mean "expectations".  If, however, you were fired for reasons unrelated to the above, and if you feel the reasons were a pretext for firing you because of your age, gender, race, religion, nationality or some other protected class, you may have been wrongfully terminated based on illegal discrimination. If you were reprimanded/written up for breaking a company policy, that policy must be in writing, and the right to see it. If you haven't done so, you should explore whether you're entitled to severance pay, and if so, make sure you get it.    ... Read More

Are employers required to conduct a sexual harrassment investigation prior to terminating an employee?

If you were an employee 'for hire', with no contract, unless there was an employee manual or policy on this topic that provided for a review, or you have a good faith basis for alleging the termination was due to a violation of a constitutional protection, then you likely have no recourse. Unfortunately, whether the 'employer' terminated you without cause will not be helpful- unless you had a contract of employment, then your employment was 'at will', and you could be terminated for any reason, unless it violated a constitutionally protected classification. That a younger person of another gender is getting the job may not prove that the termination was based on age/gender discrimination. This is a difficult case to determine over this forum. That your own employer 'sandbagged' you does not present his actions in a favorable manner. However, procedurally, I do not understand the 'references' issue. As for defamation, this would be difficult to prove, as you would need the testimony of the 'client'. As for wrongful defamation, that would depend on whether you had an employment agreement, and that agreement was violated. In the absence of such an agreement, no 'wrongful termination' case can be brought, as your employment would be 'at will'.
